Deputy pleads not guilty to jail cell assault of 15-year-old girl

A King County, Washington police officer has plead not guilty to fourth-degree assault after a judge agreed to the release of a video showing a 15-year-old girl being thrown against a wall, beaten and picked up by her hair.

A county prosecutor told the Seattle Post-Intelligencer the violent behavior should be considered "criminal misconduct," concluding "he should be prosecuted."

Captured November 29, 2008 in a SeaTac City Hall holding cell, the clip was released over the objections of Deputy Paul Schene's attorney, who insists it does not "tell the whole story."

The girl and another 15-year-old female were arrested on suspicion of auto theft. The vehicle they were allegedly driving belonged to the victim's parents.

"Several years ago, Schene shot and killed an unarmed, mentally disturbed man following a traffic stop that degenerated into a 'knock-down, drag-out' fight," noted William Grigg at lewrockwell.com. "The shooting was ruled 'justifiable.' Shortly after that incident, he was stopped for driving under the influence (apparently of prescription medication). He was given a deferred sentence and placed on probation, so that he could continue to bless the people of King County with his singular professionalism."

6. It's SOP for the police union's lawyer to plead like this from the get-go
It doesn't mean it won't be changed later or that it would hold up in front of a jury.

Having viewed it, I just don't see any way this guy could have justified what he did, esp given that he had another deputy there, and there were several other options that could have been chosen.

Primary amongst them simply closing and locking the cell door.

He's toast, and deservedly so.

I don't care what happened before or after the part that was filmed. Nothing justified the beat down he gave that girl. It wouldn't have justified him treating anyone, even a grown man, that way.

I hope I get to read the deputy's side of things. It should be entertaining.

"Nieves pulled up, got out of the rental car and rushed to help the driver of the minivan. Leopard ran to help the officer, Paul Schene of the SeaTac Police Department, who was dazed, still in the driver's seat and suffering from a broken arm and leg injuries.

"I was trying to tell him to relax until the fire department comes and then all of a sudden the (patrol car's) engine caught on fire," Leopard said.

"I yelled for Sgt. Nieves. He came running over. We reached in and couldn't get the driver's side door open, so we reached in through the driver's side window and were able to pull him out," Leopard said.

After the two carried Schene to the safety, "we turned around, and the whole police car was in flames," he said.

I do not believe cops have any more bad people in their ranks than any other job though.

20. That's not fourth-degree assault. It's first or second. Fourth is a cop-out by the prosecutor
to keep the bastard from doing serious time. If I'd done that to someone in a bar, I wouldn't get RORed out onto the street and I'd be facing jail time.

Actually, I agree with him. He's not guilty of 4th degree assault. He's guilty of 1st-2nd degree assault and battery of a minor and needs some jail time.

25. Even after the punch on the wall
The two male officers had her under control. Both men probably weighing 175 pds each had her arms pinned and yet he rears back and punches her twice.

If the two officers were so concerned about her shoes why didn't they take them from her before putting her in the cell? Also, why wasn't a female officer available?

This is 1st degree assault and the longer that King county protects this criminal the more money they will lose in the lawsuit that is surely to come.
