Kennedy Eyes Suit on Pryor
Sen. Edward Kennedy (D-Mass.) has asked his staff to put together a case that he hopes will prove that President Bush’s recess appointment of Alabama Attorney General William Pryor to the U.S. Court of Appeals was unconstitutional.

At issue is whether the 10-day period when Congress was away constituted a “recess” in which such appointments are provided for in the Constitution.

Some constitutional scholars believe that the Founding Fathers may have been referring to the far lengthier recess periods that occur between sessions and Congresses. Recesses lasting many months were common in the early days of the Republic, before the advent of mid-session breaks.

President Bush last Friday used a recess appointment to put Pryor, an outspoken opponent of abortion and homosexuality, on the Atlanta-based appellate court, which covers Alabama, Georgia and Florida. Democrats have strongly denounced the move.

4. Wasn't Pickering appointed during a similar recess?
Does anybody know how long the recess was during which Pickering was appointed?

So his appointment would not be in question- but IIRC, his appointment runs out in Fall 2004, while Pryor's runs until Fall 2005. Because of this, I am concerned about Pryor's appointment more than Pickering's anyway.

I think the pResident may be a little confused.

Seems events of 30+ years ago finished off Ted politically and gee, he never stole money, drove us into an unjust war, started spying on fellow Americans!

and his crowd are screwing around with our founding document.

So far-

Bush promises to amend it over the gay marriage issue

Orrin Hatch is researching how to amend it so the Gropenator can run for the presidency

More focus on how bush is screwing around with the Constitution will add to the irritation the public is already feeling over his presence in the White House.
