Fast food giant loses in McDonald's vs. McCurry tiff
Source: Reuters via Yahoo! News

PUTRAJAYA, Malaysia (Reuters) – Fast food giant McDonald's on Tuesday lost an eight-year trademark battle against a Malaysian curry restaurant after the country's highest court allowed the latter to use the prefix 'Mc'.

Malaysia's Federal Court dismissed an application by McDonald's Corporation to appeal against an earlier Appeals Court judgment which allowed McCurry to use the prefix.

1. "McScrewed" sounds like it should be a chain of brothels. Wonder
how they manage the drive-thru part of the biz?

4. I knew about the weddings but not the strip show. I suppose, though, I should not be surprised. It's
just like the pay a quarter (or whatever they cost now) peep show idea, but you never have to go find a parking space.

3. Well, now McBarf can concentrate on trying to come up with a healthy menu
that actually tastes good. Instead of trying to be a 200 pound corporate bully a la Monsanto. A corporation that loathes family farms and sues them if their Frankenstein seeds escape and grow where they are not wanted.

11. Because it's McDonalds or because the case sucked?
I'm glad they didn't win either because their case was fucking stupid. I hate it when companies try to pull shit like this... As if anyone is going to confuse McCurry with McDonald's.

12. Eh, guys are you sure some of you are not being blinded by anti-corporation?
Just for a moment try seeing it from McDonalds point of view, they have spent if not billions building up a brand and the Mc does play a large part into that from McNuggets to things like their McFurry.

14. I've never understood how a corporation has the rights to
what is a part of many peoples surnames, not to mention the poor McDonalds of the world.
McDonalds once sued a McDonald for using his name on his little restaurant in Scotland. What jerks- if I remember right the big Mick lost. If they want exclusive rights to a name then let them make one up like EXXON.

25. Well imo thats 90% the corporations own fault, they kind of do
have a bad reputation overall and if you look at history it does tend to bear that out.

26. i of course disagree
corporations have made my life FAR FAR better.

the very computer i am typing on now was made by a corporation.

media tends to portray businessmen and corporation as evil, but that has not been the reality i see in the real world.

i realize that many people here are strongly anti-corporate. i am not.

33. like everything else involving people
some are good, some are bad, some are evil, some are beneficent, some are a credit to society, others a burden.

but the zeitgeist HERE is that CORPORATIONS = BAD. LABOR = GOOD.

the reality is that both can be either of the above. cause they are made up of people, with all their faults, foibles, desires, competing interests, beliefs, creeds, etc.

22. Not blinded
It was just one restaurant that had no golden arches that just happens to have a 'Mc' in front of their name. There is really nothing to see from their point of view. I don't like the idea of them having sole ownership of 'Mc' considering it's common when it comes to a lot of last names. My mom's side of the family have a 'Mc' in their last name. I don't have a problem with McDonald's so much. Just don't agree with him here and I'm considering a lifetime boycott.

That's the issue afoot. And I don't think it was stolen. And it looks like a judge agreed. McD lost to McC.

32. ah! yes; the famous McD' bump - popularly termed the McDump, or McDumpling.
what the hell is it with these rich fascist corpophagist scum?

donald trump tried similar shit. can't remember details; but, i believe he tried to trademark a common phrase in the english language. and there was the w. g. grace corp. trying to trademark the formula for an ingredient in the south asian neem plant - which has been used by ayurvedic physicians & farmers in south asian countries for over 3,000 years as an antibiotic, antiseptic & insecticide. isn't it enough that they've already cornered 80% of the wealth on the planet; where does the rapacious greed stop? they are like so frikkin insane with the lust for power & wealth, they can't even get it into their single-celled brains that they are destroying the very society which perpetuates their feeding frenzy, by buying their trash.

where mcdonald's sued McDharma's(a healthy drive through) and won.

<snip>>

What's in a McName?

Michael O'Loughlin

January 17, 1988

"It's official. McDharma's Natural Fast Foods is no longer McDharma's. The little vegetarian cafe on the outskirts of Santa Cruz, subject of media attention from Toronto, Canada, to Melbourne, Australia, has agreed to drop the "Mc" from its name.

The signs and menus at the popular restaurant still carry the logo "McDharma's," but there is one of those international "no" symbols - a vivid circle with a diagonal red line - slashed through the "Mc" in the name.

Why? Because McDonald's, the multi-billion-burger Goliath, chose to fight the tofuteria's attempt to register its name as a legal trademark.

According to Bernie Shapiro, 38, co-owner with Daniel Prather, 34, of the vegetarian cafe, the idea behind the name McDharma's was to combine elements from the Eastern and Western worlds without compromising either. "Mc" was intended to convey the idea of fast service, while "Dharma" means "virtue or right action." The name McDharma's came to be associated with "natural, fast food."

In 1986 McDonald's generated $3.7 billion in..."
