Hearing scheduled in case of Capt. Connie Rhodes and attorney Orly Taitz

A federal hearing has been scheduled in the case of an Army captain seeking to avoid deployment based on arguments that President Barack Obama can’t legitimately hold office.

A hearing for Capt. Connie Rhodes is set for 2 p.m. Friday, court records show. Rhodes claims the president is “an illegal usurper” and “an unlawful pretender” and that she cannot lawfully act under his authority. Defendants include Obama, U.S. Defense Secretary Robert Gates and Col. Thomas MacDonald, Fort Benning garrison commander.

Rhodes seeks to stop Gates, MacDonald and others from giving her and others until Obama’s citizenship status is established, her complaint states. She also seeks conscientious objector status based on her doubts of Obama’s legitimacy.

4. They did
Major Cook no longer has a job with the DOD, and he was just a reserve officer.

Captain Rhodes is active duty, and has disobeyed a direct order, missed movement, and has used contemptuous speech directed against the President of the United States, all offenses under the Manuals of Courts Martial and the Uniform Code of Military Justice.

5. Rhodes didn't report on August 30 as ordered.
So I wonder when the UCMJ will kick in? She shouldn't be hard for the MPs to find.

3. State Bar of California won't do anything.
The State Bar is the only bar association that operates a State Bar Court, equipped with judges who specialize in handling professional responsibility cases. Under the State Bar Act, upon receiving a complaint, the Bar may choose whether to open an investigation. If the Bar does find sufficient evidence of misconduct, decides that it has standing, and decides to take action to impose discipline, it has the power to proceed against accused attorneys either in the Supreme Court of California or in the State Bar Court. The State Bar holds that it may decline to review complaints that are not made by a Judge who heard a matter related to the complaint. Complaints of professional misconduct are usually first prosecuted in the Hearing Department of the State Bar Court. If the lawyer disagrees with an adverse decision, he or she may appeal to the Review Department of the State Bar Court, and from there to the state supreme court.

"The State Bar holds that it may decline to review complaints that are not made by a Judge who heard a matter related to the complaint."

But first someone has to file a complaint against Orly, so far, no takers for that privilege!

Unbelievable. Jesus I wish that was available during VietNam. Hardly anybody believed Nixon was human. Yet he was able to send thousands and thousands to their death.

11. That one won't fly
In the United States, there are two main criteria for classification as a conscientious objector. First, the objector must be opposed to war in any form, Gillette v. United States, 401 U.S. 437. Second, the objection must be sincere, Witmer v. United States, 348 U.S. 375. That he must show that this opposition is based upon religious training and belief was no longer a criterion after cases broadened it to include non-religious moral belief, United States v. Seeger, 380 U.S. 163 and Welsh v. United States, 398 U.S. 333. COs willing to perform non-combatant military functions are classed 1-A-O by the U.S.; those unwilling to serve at all are 1-O.

The "I think the black guy is from Kenya" objection isn't going to work.

It's one thing to be a consciencious objector which I support in any case.

That's not the case here. Not even close.

MAKE A FUCKING EXAMPLE OF THIS SOLDIER.

I served. This is not the way to go about with her protest.

18. The hearing has been rescheduled for Monday.
According to the Ledger-enquirer. I can't furnish a link, I supposethat's because I've hit their site all the times I'm allowed for free, and now they want me to subscribe.

Looks like Rhodes forgot to ask for time off to attend today's hearing.
