INDIANAPOLIS (WISH) - The court stated, “Based on the foregoing, we conclude that the Voter I.D. law violates Indiana Constitution Article 1, Section 23, and must be declared void because it regulates voters in a manner that is not uniform and impartial. "

3. It's a developing story - our outlets love to leave us hanging ...
... basically the required voter ID is driver's license, school/college ID, or gov't issued ID and the argument against that is that many elderly, poor, and inner-city people don't have - or don't have the means to - any of these forms of ID, so it places an unequal burden on them to have to provide it.


:shrug: I'll update the link if/when more info is available ...

About freakin' time.

The WISH story is pretty lame. It doesn't even say which court issued this ruling. I thought the Indiana Supreme Court already upheld voter ID but I could be wrong.

The Indiana Court of Appeals today declared Indiana's voter ID law unconstitutional because it does not apply uniformly to all voters. The three-judge panel unanimously held that the requirement that voters present government-issued photo identification at the polls runs afoul of the Indiana Constitution's "Equal Privileges and Immunities Clause," which provides: "The General Assembly shall not grant to any citizen, or class of citizens, privileges or immunities which, upon the same terms, shall not equally belong to all citizens."

Two reasons were cited by the Court of Appeals: the law doesn't require absentee voters to provide an affidavit affirming their identity even while requiring photo identification for in-person voters; and the law exempts residents of state-licensed care facilities from the ID requirement if their facility happens to be a polling place.

The challenge was brought by the League of Women Voters, based on state constitutional claims, after the U.S. Supreme Court previously upheld the law. Because the newer lawsuit deals only with state-based claims, the U.S. Supreme Court cannot review today's ruling.

Instead, Indiana officials can ask the Indiana Supreme Court to review the ruling. But for now, the Court of Appeals' decision orders Marion Superior Court, which had ruled against the League of Women Voters, to declare the voter ID law void.

6. This looks like sarcasm, but ...
very little voter fraud is committed, throughout the country.
But there is a lot of election fraud committed.

The reason the 7 US Attorneys got fired, because they wouldn't
prosecute voter fraud cases. The people that the Bush Admin wanted
to prosecute, the US Attorneys said that there was no evidence against
them, and they won't create evidence against them.

As for the number of voter fraud cases around the country, I don't
have the exact number, but it is less than 2 dozen.

11. And 90% of them are...
...worshippers at the Church of Limpblob.

They are the ones with the means and incentive to go from place to place in order to game the system.

So I am not totally sure of this being a win. What WOULD be a win is if the poor and elderly were given a reasonable, free or ultra-low cost way of getting the ID which is necessary to function in this society.

13. Indiana court strikes down state's voter ID law

INDIANAPOLIS— The Indiana Court of Appeals has struck down the state's voter ID law, saying it violates the state Constitution.

The court ruled 3-0 today that the law must be declared void because it regulates voters in a way that is not "uniform and impartial." The judges say the ID law treats in-person voters and mail-in voters differently.

The League of Women Voters challenged the law on state constitutional grounds after the U.S. Supreme Court had upheld it. The lawsuit included the League’s claim that 12 nuns were denied the right to vote in St. Joseph County because they lacked ID cards.


The Indiana law was passed in 2005 by a Republican-controlled legislature, requiring voters to show government-issued photo identification.
