Holder Failed to Disclose Brief on Detainee Policy

WASHINGTON — During his Senate confirmation hearings last year, Attorney General Eric H. Holder Jr. failed to disclose that he had signed a brief urging the Supreme Court not to uphold President Bush’s claim that he could imprison an American citizen as an “enemy combatant,” the Justice Department acknowledged on Thursday.

“The brief should have been disclosed as part of the confirmation process,” said Matthew A. Miller, a Justice Department spokesman. “In preparing thousands of pages for submission, it was unfortunately and inadvertently missed. In any event, the Attorney General has publicly discussed his positions on detention policy on many occasions, including at his confirmation hearing.”

But at a business meeting of the Senate Judiciary Committee, which held the confirmation hearing, Senator Jon Kyl of Arizona, the second-highest-ranking Republican in the Senate, said that explanation “strains credulity.”

IMHO

Any such involvement on the part of Roberts and Alito are clearly violations of the Federal Code of ethical Judiciary conduct, barring any action appearing to compromise impartiality.

TIME FOR AN INVESTIGATION OF THEIR INVOLVEMENT WITH THE FEDERALIST SOCIETY TOGETHER W/ POLITICIZATION OF THE FEDERAL JUDICIARY !

4. Bybee forgot to mention his part in the torture plan
If Vile Kyl wants to go down this road, then Leahy can too. Besides, what Bybee was involved in was more evil then Holder signing a brief that American citizens should be protected by the US Constitution, and not have their rights taken by the idiot in chief.

I thought court records were public documents. Why does it have to be "disclosed" if it is on the public record?

I am more concerned about John Roberts lying to the senate about his views on stare decisis.

10. +1 Also his partisanship, as reflected in his recent statements about the SOTU.
He had no problems with being at the SOTU while adulation was being lavished on Bush.

8. Holder should be trumpeting this, not back pedaling
No President should have the sole power to lock someone up forever on just their say-so..and at the same time denying them all Constitutional Rights. Like not even having to tell them what they are being locked up for...
