Neb. to join health care (reform) lawsuit

LINCOLN (AP) — A Nebraska legislative proposal to try to fight health care reform appears unlikely to pass.

But it the state will join a lawuit challenging the constitutionality of federal reform once President Barack Obama signs the bill.

Earlier this year, a state senator proposed an amendment to the Nebraska Constitution to prohibit the state from forcing people to buy health insurance or fining people for not obtaining insurance.

But that measure from state Sen. Beau McCoy of Omaha remains in committee, and it is unlikely to advance because less than a month remains in this year's session.

3. No idea, assuming the administration gets a reasonable judge and not one of the toadies
who leans towards the far right I dont see them having much luck overturning it on constitutional grounds especially since the states involved havent kicked out social security and accept federal dollars for a host of other programs.

10. Typical cable news
Saw an article online on CNN that was titled 'ten states line up to sue over health care bill'. So I decided to check out what party the Governors of those states belonged to. Lo and behold 8 of the 10 were Republican. I thought it was weird that the Governors of Pennsylvania and Washington would join in this farce so I checked out what party the 'Attorneys General' in those states belonged to (I think they are the ones that would actually bring the suit). Yup, you guessed it the two AGs in those states were both Repugs. Shouldn't the title have read 'Republicans threaten to use state postions to attempt to defeat in the courts what they couldn't defeat in Congress'. What's scary about this is we know that Reagan and the Bushes did everything they could to stack the court with rightwing ideologues so you can never be sure what is going to happen. If it gets to the Supreme Court don't put it past Scalia, Roberts and there cohorts to come up with some cock and bull decision that says that basically the Democratic majority doesn't have a right to pass its own bills.
