Delegate aims to stop Cuccinelli's health care suit (Virginia)

WASHINGTON - A Virginia lawmaker is starting his own campaign to stop Attorney General Ken Cuccinelli from moving forward with his lawsuit against the federal government over health care reform. Alexandria Del. David Englin (D-45) has created a Web-based telephone campaign asking Virginians who support health care reform to call Cuccinelli and express their opinions. Cuccinelli filed a lawsuit against the government on Tuesday over the health care overhaul bill, calling it unconstitutional.

The bill's requirement that U.S. citizens buy health insurance undermines the U.S. Constitution and Virginia state law, Cuccinelli says. Englin says suing the government is not in the taxpayers' best interest and - contrary to Cuccinelli's claims - many Virginians are not happy with his plan to sue. "My constituents have been contacting me telling me that they want me to do something to stop him. This is an egregious waste of taxpayer dollars," Englin says.

The petition Web site asks Virginia residents to fill out a simple form and leave their phone number. An automated system will then call the person back and connect them to the Office of the Attorney General.

1. Whether or not you support HCR, any laws passed by congress should be allowed judicial review.
Checks and balances, separation of powers, and judicial review form the basis of our government.
The party or preference is irrelevant.

If the AG feels a federal law violates citizen's constitutional rights, it is his duty to appeal to the SCOTUS to make a ruling.
If the HCR bill is found to be unconstitutional, then it should be overturned or fixed to comply with the constitution.

In very broad terms, I suppose what you say has some merit. But let's face it. These lawsuits wouldn't be being filed if it were bush in the white house. This is just a continuation of the 2008 campaign by people who can't wrap their mind around the fact that there's a democrat and/or black guy in the white house.

That the democrats (or any other AGs) did not challenge any of the Bushco administration is their own fault. Shoulda woulda coulda. The Patriot Act is about the most unconstitutional thing ever created. It's a wonder to progressives why Obama isn't looking to can it. Even if the HCR is being challenged for the most nefarious, bigoted, & racist reasons... it can still be challenged and should be allowed to be challenged.

The right and duty to judicial review exist and to try and deny such process would only be embraced by the most brazen of hypocrites.
Let them challenge it. If it's unconstitutional... maybe the next bill wont be. :shrug:

8. It's not irrelevant b/c Cuccinelli is doing this for HIMSELF and his political ambitions and NOT
out of any concern for the taxpayers of Virginia.

Cuccinelli is the slimiest politician and human being you can imagine and anyone who is working to expose that fact to a wider audience has my 100% support.

13. By the same token the people have a right to express their discontent over partisan lawsuits.
If enough people in the state say to stop then the AG should listen but as we all know, ONLY Republicans know what is right and what is wrong..They always have all the answers and are NEVER wrong..

4. Virginia
is closing schools because of a budget problem, but Virginia has the money for frivolous lawsuits? I don't think so and I'll be raising some hell about it.

6. i wish VA wasn't bringing this suit but there is no way Cuccinelli is backing down
This suit isn't about the HCR, its about Cuccinelli positioning himself to run for governor in four years. If he was to back down he'd be dead to the repubs in VA. So expect him to push this as far and as long as he can.

wingnut a-hole and incredible danger to our state that he is as far and as long as we can.

There is NO WAY IN HELL I'll allow Cuccinelli to become our governor. NO WAY IN HELL.

11. Mich's Goppers A.G. is pulling the same shet.
I emailed him telling him to knock it off.. Among my comments. If the Supreme court overturns this bill, Justices Scalia and Roberts need by impeached. We've already have grounds with their treason after corporate money was freed under Citizens United vs FEC.. And the corporate control we'll have over our politics.. . Also, I suggested Michigan citizens need talk up starting a recall effort against Michigan Repuke Att. Gen. Mike Cox..

12. I have a theoretical question.
Given the corporations seem relatively happy with this bill, its a long shot that the corporate owned members of the supreme court would over turn it.

But, say that it goes to the SCOTUS, and they rule that the mandate is unconstitutional. What then? Is the whole bill thrown out, or just the mandate? How does that work?
