Syracuse, NY - Gov. David Paterson’s decision to call for a special election -- on Election Day -- to fill former U.S. Rep Eric Massa’s Southern Tier congressional seat will not stop a lawsuit from going forward seeking an earlier election, a Syracuse lawyer says.

“The governor’s calling of a special election for November is an obvious attempt to circumvent the constitutional mandate that a prompt special election must be held,” lawyer John Cirando said in a written statement released Thursday afternoon.

Cirando said the plaintiffs in a lawsuit he filed last week in federal court in the Western District of New York would proceed with their lawsuit
