All Mexican states must recognize gay marriages

MEXICO CITY — Mexico's Supreme Court ruled Tuesday that all 31 states must recognize same-sex marriages performed in the capital, though its decision does not force those states to begin marrying gay couples in their territory.

In a 9-2 decision, the tribunal cited an article of the constitution requiring states to recognize legal contracts drawn up elsewhere.
It did not specify what degree of recognition must be granted to same-sex couples.

Mexico City's same-sex marriage law, enacted in March, extends to wedded gay couples the right to adopt children, to jointly apply for bank loans, to inherit wealth and to be covered by their spouses' insurance policies. Some of those may end up applying only in the capital.

The Supreme Court ruled last week that same-sex weddings are constitutional — though it is holding separate discussions this week on the adoption clause...

2. This is the same way we will get to marriage equality in this country
I cannot see the current composition of the SCOTUS deciding by a majority that a right to same-sex marriage is in the Constitution, but it will be very difficult for them to ignore the plain language of the full faith and credit clause. If equal marriage is available anywhere in this country, it will require recognition everywhere in this land. The California case is going nowhere, but the Massachusetts case is the road to freedom.

10. yep... was thinking that a few weeks back, and hoping and I will certainly pray that he realizes the
clarity of equality given to all citizens.

12. Kennedy can be quite conservative at times
I can see him saying that there's no inherent right to gay marriage in the Constitution, but there is the rule that each State has to abide by the others' judicial acts. That's how we get what we want in a roundabout way.

6. Maybe...
it's written in to the Mexican constitution that religious figures cannot politick from the pulpit. It's actually an amendment to their constitution of 1917. Sometimes the laws are relaxed a little, but if the Church gets too lippy, there are avenues to knock them down a bit.

and since I'm assuming you don't have your finger on the pulse of Mexican politics, you don't realize that people protest for this constantly. That's fine. There's the law, and there's *the law*. The government could crack down on the Church tomorrow if they so chose, and if the people would allow it. At the moment, the Church can open its mouth-though it's clear that the judicial branch isn't listening.
Right now, there's an oddly conservative bent in Mexico. Mexico is more conservative in spots than is true in the US, and more liberal in other places. It's a very divided country. This is an astonishing result, considering Mexico City is rather liberal, but the second largest city, Guadalajara, is somewhat more socially conservative.
Change is incremental, and as a woman, it disturbs me that abortion is illegal. However, as the daughter of a gay woman, and a fierce advocate for GLBT rights, I see bonuses where I can. The Church clearly had no influence on this decision.

5. And Mexico has spoiled homophobic American conservatives' travel plans.
Looks like those who can't stomach the idea that two men can get married have to go to Africa, the Middle East, or the Carribean now. But good for the Mexicans!
