Asylum seekers can sue over sex demands

(09-02) 18:38 PDT SAN FRANCISCO -- Two Chinese women who said a U.S. immigration hearing officer offered them political asylum in exchange for cash and sex can sue the government, a federal appeals court ruled Thursday.

In a 2-1 decision, the Ninth U.S. Circuit Court of Appeals in San Francisco said the officer, who was prosecuted and imprisoned, had been acting "within the scope of his employment" with the government, which can be held responsible for his conduct.

The officer, Thomas Powell, "abused his powers for his own benefit," Judge John Noonan said in the majority opinion.

Dissenting Judge Jay Bybee said Powell's "lewd and selfish conduct" was unrelated to his work duties.

JAY BYBEE? You mean the Jay Bybee who wrote the "legal torture" memos? Wow he always manages to put some BS legalese in his rulings.

1. Using Bybee's logic
nobody who is corrupt could EVER be held accountable for doing anything illegal or harming anyone while in office simply by stating that whatever they did was outside of the scope of their work duties.

Leave it to someone who officially justified torture to now try to officially justify Everything Else!
