Charges to be dismissed against police officer in Midwest shootings
Source: CNN

A police officer jailed on a first-degree murder charge in a two-state shooting rampage was on his computer at the time of shootings and could not have committed them, prosecutors said Tuesday evening.

Brian E. Dorian, 37, was to be released on his own recognizance Tuesday night, and charges against him will be formally dismissed Wednesday, Will County State's Attorney James W. Glasgow announced.

"I feel horrible that Brian Dorian went through this," said Glasgow, adding that evidence at the time and identification in lineups merited the charges. "At no time did we stop looking for exculpatory evidence."

A forensic analysis of Dorian's home computer and its activity put Dorian at home at the time of the shootings, authorities said. The officer also told them he was watching sports programs and using e-mail.

3. that is not an ID. Anyone could be on his email. was there a camera on his computer recording him?
just saying...  i think this is fishy.
but who cares what i think.

4. I do...I agree!
I just hope it is not a move to protect the an entire police department...Which according to my experience while working in the criminal justice arena is all of the police, the DA & the Judges.

A perfect example is AZ Sheriff Joe Arpaio...But he is not the only one who operates like this many if not most others do as well. Police, DA & Judges are one big team.

6. it's possible. OTOH it would involve someone else being involved in a conspiracy
to give the guy an alibi while he goes on a shooting spree. If it was a bank robbery or something of that ilk, I'd be suspicious. This sort of crime seems too random to have that kind of planning. Also, if the guy lived alone it would be less likely than if he had a family or roommate. Sure, it could still end up that he did it, and I assume he's not completely off their radar, but it seems to be a case of mistaken identity at this juncture.

for everyone else.

So how often do they dig and dig for evidence to prove non-police suspects innocent? Especially evidence as flimsy as "He was sending email!".

11. Quite easily...
using RDP, VNC, GoToMyPC, etc. And yes, if you are using a computer remotely to access a site the site being accessed will show the IP address of the remote computer in it's logs. This is a rather flimsy exoneration.

it seems first of all it requires installation or activation of a program. I am thinking the computer forensics investigators would think to check that, no?

13. Circumstantial alibi.
Unless the suspect was seen physically sitting at his computer, this is NOT an airtight alibi. I think the department is trying to cover up something MUCH LARGER.

15. Really?
Departments who are covering up usually can only keep things covered prior to turning cases over to prosecutors, formal charges being filed and disclosure to the courts. What motivation would judges, prosecutors, and local, state (at least 2 states), and federal law enforcement have to "cover up" an interstate murder spree? None would be the answer to that question.

First he was arrested because of a line-up

Then this:
The charge against Dorian unraveled after intensive tests of his computer indicated it was being used about the time of the 10:30 a.m. killing on Oct. 5, Glasgow said.

Questioned by authorities after his Tuesday court appearance, Dorian was able to tell them what sites he had visited on his computer around the time of the killing. “He verified the websites he was on,” Kaupas said.

Meanwhile, Dorian’s childhood friend Tom Moran said he spoke with Dorian by phone shortly before Dorian was supposedly in Lowell, Ind., on Oct. 5. And Dorian then came by Moran’s home in St. John, Ind., to drink coffee shortly after.

“We talked for a little bit and then he took off,” Moran said, adding that they talked about the Boston Red Sox and Dorian’s planned trip to Iowa.
