Federal judge dismisses challenge to health care reform

Detroit— A federal judge today dismissed remaining claims in a lawsuit challenging President Barack Obama's Health Care Reform Act of 2010. U.S. District Judge George C. Steeh issued an order that dismissed four claims, effectively ending a lawsuit filed by the Thomas More Law Center, a Christian public interest law firm in Ann Arbor. The suit, like similar lawsuits across the nation, argued Congress exceeded its authority by requiring most people to obtain insurance coverage or pay a penalty by 2014.

The move comes two weeks after Steeh, appointed by former President Bill Clinton, upheld provisions of the health reform act and dismissed other claims in the suit.

Like the Ave Maria School of Law, the Thomas More Law Center is a creation of Tom Monaghan

in Jesus' time & place it was sandal straps - at least for the rabble that followed him around looking for free food & medical care.

The dismissal will let the law center appeal Steeh's ruling.

11. Some Christians
So this is what Tom Monahan's army of zealot robo-lawyers are up to: challenging efforts to expand health care to more Americans and stalking gay college students? Bravo, Tom, Bravo...

15. No to Universal Care
I recently had a conservative "religious" woman tell me how she is against universal coverage. She agreed the current situation needs fixing but did not think there should be universal coverage.

I find that very difficult to process.

16. Cheer if you want, but
This is still a flagrant violation of the Federal government's Constitutional authority - They have the power to tax and even that took a Constitutional Amendment. We will never get true universal care at this rate - just gov't welfare for the unnecessary middleman - the health insurance industry.

17. nope
sorry. because the Government provides the baseline coverage for those without any (through grants and direct payments to hospitals that are unable to refuse treatment under the law) the Government has a vested interest in reducing those costs. if you don't have insurance and need emergency care, the government ends up covering those expenses, one way or the other. therefore, the government can mandate residents insure themselves to protect society from paying the costs of treatment.

or do you think the government is the only entity in the world that is not allowed to address the free rider problem?

if ACA is unconstitutional, then it is unconstitutional for the government to require that emergency rooms, as a public good, treat all comers, regardless of ability to pay. heck, it's probably unconstitutional to require that medicare payments go to licensed physicians. heck, medicare itself is probably unconstitutional.

20. I share your angst.
Most on this board are unaware, or at least seem unaware, that while Obama was busy meeting with very Conservative Senators, he and Rahm wanted nothing to do with real reform.

It would have been very very bad for their friends in the big insurance and big pharmaceutical industries.

21. Widespread corruption
My NJ Senators, Menendez and Lautenberg, both strong supporters of HCR and even the public option, lined up against the proposals to allow importation of prescriptiondrugs from Canada and other pharm reforms. Pharm is huge business here in NJ so they were doing what was best for the NJ economy instead of what might be best for the country. The big donations did not hurt their opposition either.

It all comes down to the money.
