Marine wants leniency for illegal immigrant father

A Kentucky Marine soon to be deployed in Afghanistan is asking for leniency for his father, who is facing deportation.

Lance Cpl. Aspar Andres spoke at a news conference on Monday, saying his father, Juan Andres, is a hardworking farm worker who is proud of his son's military service.

Question: if someone's been in America for a quarter of a century and not been arrested or come to the attention of the authorities in all that time, are the odds not good that they'd probably make a good citizen? And after 25 years, what connections have they remaining with the place they left?

Here in the UK, anyone who's been in the country for 14 years, legally or illegally, is eligible for "indefinite leave to remain" (a residency status that leads to citizenship within a year). This seems eminently fair and reasonable, since, as noted, even an illegal immigrant who's done nothing to be arrested in that length of time is not likely to be a dangerous criminal, and removing them from the community in which they're well-established to "return" them to a place that they no longer have any real or meaningful connection to is quite arguably inhumane. I also have to say that I find it interesting to see that the fuckedupness of American immigration and residency laws has so many staunch defenders on a supposedly left-of-centre forum.

6. He was arrested and deported in 1995
That may be the bump in the road.

O'Neill said Juan Andres is not entitled to a court review because of a previous case. He was deported in 1995 after being arrested in Georgia while driving other migrant farm workers in the country illegally, but eventually he came back.
