Order Blocking Collective Bargaining Bill Extended Indefinitely

MADISON, Wis. -- A Dane County judge has extended the temporary restraining order on the collective bargaining bill indefinitely.

Judge Maryann Sumi said she can't make a decision without testimony from lawmakers who have immunity, 12 News reporter Nick Bohr reported from Madison.

The second day a hearing to decide whether Wisconsin state lawmakers broke the open meetings law is ended several hours earlier than expected Friday.

Bohr was covering the hearing and said the Dane County district attorney claimed leadership members of the state Senate and Assembly didn't meet the necessary notice guidelines before voting on the controversial bill. The bill limits collective bargaining for public employees.

.....Instead of a decision, Sumi gave lawyers in the case three legal questions she wants them to research and answer, setting a seven-week period for legal briefs and responses. In the meantime, the case will also wait for the four lawmakers who are asserting legislative immunity — Senate Majority Leader Scott Fitzgerald, R-Juneau; Senate President Michael Ellis, R-Neenah; Assembly Speaker Jeff Fitzgerald, R-Horicon; and Assembly Majority Leader Scott Suder, R-Abbotsford — until they waive their immunity privilege or are out of session and can be served with the lawsuit.

That could be months. District Attorney Ismael Ozanne, who filed the open meetings lawsuit, said there are windows in which the Legislature is not in session in July and December. State law grants immunity to legislators during sessions and for 15 days before and after sessions, but it's not settled whether sessions are defined as legislative floor periods or entire two-year periods between elections.

None of the lawyers in the case could answer that question definitively and will likely argue it in legal briefs to Sumi.

Ozanne said after the hearing that there is a remedy to the long courtroom standoff.

8. Immunity is permanently revoked.
By the order of the people of the State of Wisconsin. These scumbags do not deserve immunity.

Their assertion of immunity is hereby rejected and must be ordered to testify.

Refusal to testify needs to be a mandatory weekend stint in the worst prison in Wisconsin, in general population.

...is dependent on members of the corrections officers union.

Sadly, in the Corporate States of America, Sharia law will apply and the Kochs will buy their way out of jail.

9. If these republicans believe so strongly in this legislation, why are they hiding behind immunity?
Why not go on the record and explain their actions and how they followed the prevailing law? Seems like a cowardly thing for these guys who are making the 'tough decisions'.
