Team Prosser: We Will Object To Any Recount

Wisconsin Supreme Court Justice David Prosser held a press conference at the state Capitol on Monday, in which he declared victory in his reelection race -- and at which his campaign advisers said they would object to any recount that might be requested by Prosser's opponent, Assistant Attorney General JoAnne Kloppenburg.

This is odd. It's like asking for a recount. Why would Prosser say this if they weren't afraid of something?

4. What a stupid position to take. The law says that this race is so
close, that the public will pay for a recount. To argue that a recount shouldn't be considered is just stupid. Once again, he shows his judgement is crap.

The Government Accountability Board has released the county canvass results of the state Supreme Court election.

The board says Prosser's current lead in the race is 0.488 percent, which would allow Kloppenburg to request a recount without paying a fee.

The difference is 0.488%. If it's less than half a percent (0.5) she gets a free recount if she requests it. 0.488 is less than 0.5.

32. Prosser's lawyer also said today any recount request would be "frivolous"
With a .048% (i think) difference?

Also said he’s prepared to object legally if Kloppenburg makes the request.

There have been at least 2 or 3 press statements on this from the Prosser camp today!

Really making themselves look even more suspicious, if possible

I would think the error in Waukesha would be enough to do that. Prosser should want a recount just to erase any cloud over his win.

Kloppenburg for Justice Campaign Manager Melissa Mulliken ... issued the following statement:

"Now that the statewide canvass is complete, our campaign will focus our decision making on whether to request a recount. By statute, we have three business days in which to make that decision. We will review the information available to us and carefully weigh the options. We will make an announcement concerning our decision no later than Wednesday, April 20, 2011."

She can request a recount and since it is within the margin the state pays. If the margin was greater than she would have to pay.

36. Wrong. The margin is under .5% therefore there's only a $5 fee per ward.
The taxpayers will pick up the bill for the recount.

39. Are you positive? In the first days the info was that they stole exactly enough votes to NOT have
a recount. It would be fantastic if I am wrong. I would love oto be wrong. but why then were the Dems fundraising for a recount? the link to send funds was on Du a while ago.

one reason folks were donating money was because when Kloppenburg was ahead Prosser was going to fight in court - so she would have had legal bills to pay.
And after when she was behind then folks thought that maybe she'd have to pay $5 per ward/precinct fee if the margin was too high.
There is still a chance that Kloppenburg will have 'legal bills' because Prosser is threatening to prevent a recount (I don't know how he can do that though).

The Government Accountability Board says Prosser's current lead in the race is 0.488 percent, which would allow Kloppenburg to request a recount without paying a fee.

The margin now is under .5% so she won't have a pay a fee.


Here are the numbers below:

Less than .5% margin there is no fee for the person that requests the recount.
Between one half of 1 percent and 2 percent, the cost to the candidate is $5 per ward.
If the difference is more than 2 percent, the candidate requesting the recount has to pay for all of the costs.

MADISON, WI – With the submission of the Milwaukee County canvass report, the Government Accountability Board has received the results of the Supreme Court election as certified by all 72 Wisconsin counties.

The results as certified by each county indicate that David T. Prosser received 752,323 votes and Joanne F. Kloppenburg received 745,007 votes.

Pursuant to law, the Board may not certify the official statewide results at this time. By law the Board may not certify statewide results until either the passage of the deadline for filing a recount or the completion of a recount.

The deadline for filing a recount request is Wednesday, April 20 at 5:00 p.m.

38. I'm trying to figure out what grounds he thinks he has for preventing it.
His attorney says that there are "a number of legal issues", but refuses to say what the grounds would be for their objection. It sounds like they've got nothing and they're desperately trying to find something.

Prosser is showing quite blatantly that he doesn't give a damn about the rights of the voters of Wisconsin. This man is a Supreme Court Justice!

The law says that a difference of less than half a percent qualifies for a recount and a Supreme Court Justice says that such a recount is "frivolous". So he disagrees with the legislature that passed this law? That's not up to a judge. A judge is supposed to uphold any constitutional law.

45. there is something we ALL need to be aware of. A recount may not be enough.
unless there is a way to KNOW that the ballots counted are the originals. We found out here in Los Angeles, that there is not a lot of accountability for the ballots themselves. It's pretty much based on "trust". that no-one would commit fraud and "we are all honest people working here"....
there is not a foolproof system, unless you have groups of at least 3 people hand counting directly at the precincts, not in a centralized place, then making each result public. that is the only way we can possibly KNOW. without guessing. There are many more election tricks available than just computer counting, although that one makes it so very fast and easy, who could resist?

Isn't a recount just that - a recount of the same votes that were already counted? If there is election fraud and the same fraudulent votes are counted in the recount that were counted in the original count, it doesn't really help anyone.

Or will a recount be able to detect which votes are fraudulent and shouldn't be counted this time around? Seems to me what they really need is an investigation and a revote if fraud is found.
