Two probes opened into Bradley claim

By Patrick Marley, Jason Stein and Don Walker of the Journal Sentinel

Madison - Two agencies are investigating a claim by Supreme Court Justice Ann Walsh Bradley that Justice David Prosser put her in a chokehold earlier this month.

The separate probes are being run by the Dane County Sheriff's Office and the Wisconsin Judicial Commission, which oversees the state's judicial ethics code. The sheriff's investigation was launched Monday; the commission's was authorized Friday and publicly acknowledged on Monday.

"After consulting with members of the Wisconsin Supreme Court, I have turned over the investigation into an alleged incident in the court's offices on June 13, 2011 to Dane County Sheriff Dave Mahoney," Capitol Police Chief Charles Tubbs said in a statement. "Sheriff Mahoney has agreed to investigate this incident."

It was not immediately clear why Tubbs would consult with the court on who should investigate the matter...................

I had posted earlier today that Tubbs (Capitol police) said they would make a statement today. Guess this is it-

I am inclined to think that something big will bust soon.

1. "Threatening or assaulting a judge is a felony, and those found guilty..."

from the OP:

........Threatening or assaulting a judge is a felony, and those found guilty of it are subject to penalties of up to $10,000 and six years in prison. Simple battery is a misdemeanor with a maximum punishment of a $10,000 fine and nine months in jail. But it was not clear if either of those statutes would be invoked in this case.

The Judicial Commission's investigation could encounter difficulties because matters of judicial ethics are decided solely by the Supreme Court. In this case, two justices were involved in the matter, and four of the five others were witnesses.

26. Watch the Roberts Court return a 5-4 acquittal.
If that happens... I'm really not sure what else it would take. I guess we're totally done at that point.

2. How does this guy treat his wife?
If he's so willing to insult and assault his female colleagues, I shudder to imagine what goes on at home.

6. Interesting...it's being followed up on 2 tracks...
And I'm thinking that this story isn't going away. Walker's comments did nothing to help Prosser, and I would have expected him to make some positive comment about his former mentor.

he gets to appoint a new right-wing judge.

13. Who will be up for election in 2012
Prosser is just starting a ten year term, anyone Walker appointed would have to face an election they would likely lose in the spring.

8. I understand investigation(s) ...
... but shouldn’t he at least be on administrative leave. They are certainly not letting this slug sit on the bench while the investigation is ongoing?

Frankly I would have handcuffed the slug and put him into protective custody (or what ever they call it) till the outcome of the investigations. If it would have been one of us common folks who assaulted a sitting judge it wouldn’t have taken the coppers over a weeks to haul our arse to the slammer.

18. Right. Any other two bit taxpayer would be sitting in jail for a mandatory
48 hour cooling off period before any investigation even began. At least that's how it works in Texas.

10. Tubbs is a good guy
between a rock and a hard place. I know he supports the democrats and protesters. But the nature of his job, he has to remain neutral.

14. Neutrality should lead him to the truth
and chances are very great that the truth is not on Prosser's side.

16. I Wonder What John Bradley (Her Father-In-Law), One Of The Flag Raisers Of Iwo Jima
would say about this? I'm inclined to think he wouldn't like Prosser very much, suffice it to say.

I should have been on this one right away. Her Father-In-Law was Corpsman John Henry "Jack" "Doc" Bradley of the US Navy. He was assigned to 2nd Battalion, 28th Marines, of the 5th Marine Division and here was his position during the flag raising

Judge Bradley husband James authored a book title "FLAGS OF OUR FATHERS" which detailed the famous flag-raising at Mt. Suribachi on Iwo Jima.

23. They Are
The sons of John Bradley still run a funeral home in Antigo, Wisconsin. Jim lives out of state, not sure where. He's the one who wrote "Flags Of Our Fathers," which was made into a movie.
