Casey Anthony Appealing Conviction For Lying To Police

Casey Anthony's attorneys have filed a notice of appeal for her four convictions of lying to police. The document was filed at Orange County Court Courthouse Friday by Anthony's lead defense attorney, Jose Baez.

Last week, a jury of seven women and five men acquitted 25-year-old Anthony of killing her daughter, 2-year-old Caylee. The jury did, however, find Anthony guilty of four lesser counts of lying to police officers about the disappearance of her child.

Or, they are not worth much and didn't bill enough hours to use up all the money her parents gave them yet and don't want to give any back.

The attention given this makes the furor over the OJ trial seem like a blip in hindsight--and OJ was a celebrity before his, er, someone's, victims were killed.

No one ever heard of Casey Anthony before her child's alleged kidnapping was reported.

Unfortunately.

Personally I think the adage "Revenge is a dish best served cold" is a fallacy.

I've only wished karmic retribution on one person in my life; when the outrage was fresh, I dearly wanted karma to bite this person right in the azz.
Hard.

What goes around, comes around. Live by the sword, die by the sword.


That didn't happen.


Time passed, and another adage: "Time heals all wounds" came true -- at least in this (and my worst) case.
-- believe me, what happened was truly foul on multiple levels.

Anyhow, I no longer wished this person their rightful karmic retribution
Live & let live...
and just let it go

ya know?

If karma had happened when my wounds were still deep and fresh and bloody, I would have not gloated
but still, would have felt some vindication.
So when it finally did catch up, I was sad and wished it hadn't happened to them
even though it was more than well-deserved.


I guess I don't have any more of a point than what (little) I made... :shrug:

her life. Like where to hide from the worldwide media, internet, and former friends and associates who will, no doubt, take payments for information about her location.

Then I think she should worry about nut-cases with guns, men and women who really might just want to go down in history as the persons who killed her, or who shot her in the face with disfiguring chemicals.

She should worry about EVERYONE, from a taxi driver, to an airline flight attendant to a local grocery clerk, who will want their 10 minutes of fame for exposing her identity and location.

Then there are those out there who will want to get into her pants...and write for a magazine about their one night stand with Casey. She's not going to find much out in the "free" world that will make her anything but constantly paranoid, constantly and rationally afraid of strangers, and constantly unable to engage in normal human relations.

Letting her out of jail may turn out the be a less humane punishment than having her under lock and key 24/7/365 for the rest of her life, however long that "OUTSIDE" life may be.

Then there is the fact that she is a sociopath, and, as with OJ, and Ted Bundy, and so many OTHER ... "normal looking" sociopaths, they often re-offend, especially if they got away with their crime the first time around.

take it from me, I read clips about this and don't know the source, nor the veracity.

I doubt any law enforcement arm will prosecute that mother/grandmother... very inhumane, IMO!

dashed in the SAME STATE, (remember we have 50+ sets of state and protectorate/territory laws covering perjury, all different).

If this were a federal trial, or Congressional testimony, most likely any perjurers would be charged. This is NOT a federal trial.

Your point about who gets charged with crimes, and who is excused, I have read my criminal law history, and you have a point.

29. Short answer is No.
Perjury occurs thousands of times every day in U.S. courtrooms yet it is rarely charged. First the prosecutors must prove that it was a lie, then they must prove it was an intentional lie, then they must prove that it was a lie that was material to the outcome of the case. All three of these can be difficult. Even if they can prove these things most prosecutors have bigger fish to fry and don't have the time/resources to fool around with it.

74. We do not know they were not related. The perjury and
resulting impeachment could have been a millstone around his neck for the rest of his life--make him a pariah. But it seems to have done the opposite. Big book fees. big fee speaking engagements.

People could not get enough of only the second President ever to have been impeached and the only one to have been deposed over sexual harassment while in office, etc. If none of that had happened, who knows how great the demand and the fees would have been?

Don't know that we can ever know, one way or the other.

Of course, he wasn't facing re-election, so maybe that did not matter much to him.

I don't know how he felt, but, for me, all the revelations and rumors were harder. And Hillary and Chelsea.

The impeachment proceedings felt to me like, "Okay, now we'll finally start to get back on track."

36. I'm not sure. Prosecutions for perjury alone are not all that common.
Plus, she is the alleged perp's mom. The prosecutor who tried the case said he hated to admit it, but he was kind of used to family members lying to cover their loved one.

I'm still not sure why you thought my comment was directed at you, but it wasn't.

"Lively" was a bit of a euphemism on my part as the now deleted posts I had seen reflect. I had found them upsetting.

67. She did NOT take the Stand, so she could NOT lie "on the stand"
One of the few parts of the trial I did catch was the Judge asking her if she wishes to take the stand and she said NO. This was TWICE asked of her and she declined BOTH TIMES. Thus she NEVER took the Stand, so she could NEVER lie on the stand, and thus can NOT be convicted of something she did not, and could not do.

I found that offensive, under the Common Law it was ILLEGAL for a party to testify. This started to change in the mid 1800s, when people were permitted to testify when they were the only person alive who could testify as to the circumstances of a Crime. Since that time the ability to testify has expanded, but the right NOT to testify remains. I found the request of the Judge offensive, in effect reversing the Common law rule, instead by such testimony being forbidden, the Judge was demanding that she CLEARLY says she would not testify. That is pressure on her to testify, pressure the common law prohibited by its prohibition of such testimony. Thus I found the mere asking of the Defendant if she wanted to testify or not offensive. It is an effort to FORCE her to testify, when the right NOT to testify is grantee in the US Bill of Rights.

Thus the only crime of lying she did, she was convicted of, that is of lying to the Police.

69. CINDY Anthony DID indeed take the stand
Read the post you replied to again. We're talking about perjury against the mother (CINDY) of the defendant (Casey). CINDY Anthony took the stand and lied her ass off thereby committing perjury. Casey was found guilty of lying to police which is a charge that is different from perjury. The prosecution has decided it is not going to press charges of perjury against CINDY Anthony for her lies on the stand though they know that she did indeed commit perjury. Apparently, committing perjury even when it's is obvious and provable is perfectly fine to the prosecution.

Prosecution witnesses are NEVER prosecuted for perjury. The Defense appears to have also called her, but that does NOT change the rule, Prosecutor NEVER charge their witnesses with perjury.

an all night session being yelled at by detectives and no lawyer present, and an "abusive" dad who helped cover up the death threatening her, etc. she may have a case for an appeal... in FL an accidental death might result in serious jail time if the parent was negligent or contributed..her dad the ex-cop knew that, so they may have been motivated to cover up an accidental death.

She told them she was "at work" at Universal Studios, but hadn't worked there in over 2 years. She claimed she left her daughter with a nanny (who doesn't exist) at an apartment 2 weeks prior to questioning, but the apartment had been vacant for over 6 months at that time.

She also has nothing to win with this as she is going to walk out of prison in 3 days free and clear. It can't be about her record - she already has felony counts against her for stealing, forging checks and other financial charges.

Jose Baez isn't her attorney for the civil suit (unless I missed something) - so why should he file as a pro bono to take this to appeals court? I am thinking this is something he cooked up while backing in the limelight of his 'win' and is doubling own so that he can up his fees 6x instead of 5.

Or do you just think about lying to the police about your dead daughter is a good thing and should be encouraged?

Or do you just think because a TV person uses a story a child murderer should go free? If so you got your wish and I am very glad you live far away from me.

I watched the trial. Guilt was proved. The jury was misinformed or mindless only they know and eventually they will realize it and live with it the rest of their lives and they should.

56. Calling C.A. evil belittles the fact that she is most likely mentally ill
Casey's mother said that her daughter was a psychopath, her constant lying, imaginary friends and her showing no concern for her missing daughter all point to this. It also would explain why it is difficult to explain exactly what happened to Caylee and why it is possible that it was accident and then Casey did a lot of things that made her look guilty.

The prisons are full of people that are mentally ill. Do they all belong there? I don't have the answer to that.

Casey may very well be guilty but she most likely doesn't see reality the way most of us do and I feel empathy for her, something she will never feel.

58. Mentally ill? Doubtful. She is SELFISH and lacks conscience. That doesn't mean she doesn't know
exactly what she is doing and why. She does. She is a master manipulator and a pathological liar, and that sure as heck doesn't make her mentally ill. She ENJOYS getting away with things. And she partied hardy while her kid was dead in a swamp. For Casey, it is ALL about CASEY and no one else. I hope she is sued for wrongful death and that Caylee gets some kind of justice.

62. Most people don't understand mental illness
and it's not easy to spot. People who are mentally impaired don't walk around with a tee shirt saying it.

I understand you guys being enraged. How could she party hardy when her little girl is dead? But thats exactly my point. I'm not saying she shouldn't be held accountable if they have the facts but we all should be a little careful unless we have those facts.

As for O.J. Simpson - I don't believe in the death penalty but if I was on a jury I think I would vote for it.

They're appealing the only guilty charges she got. All the other charges where she was found not guilty are done with because she was found not guilty of those charges. She can never be tried again on those charges where she was found not guilty because that would be double jeopardy.

76. My guess is that the appeal will be on the basis of the double jeopardy claim
that the defense brought up right after the verdict was delivered. The defense argued that since all 4 lies that she was convicted of happened during the same lengthy police interview, they deserve to be treated as one charge. Judge Belvin Perry stated that while the 4 lies occured during the same interview, they were all distinct lies and each and every one of them forced police to go on a wild goose chase and spend large amounts of money investigating her lies. The defense cited certain case law that proved their point, but Judge Perry didn't agree. Maybe they'll have better luck with a different judge with an appeal.

84. You are correct on the basis for an appeal...
the defense cited relevant case law, and the judge appeared to rule on the basis of police actions or the content of the "lie"'; not on the basis of the case law. The judge had nothing to lose...the defendant had already served the equivalent of 4 counts anyway. He wanted to look tough on TV. By rejecting the defense it made almost no difference in when she would get out. If reduced to one count she would have been out a week earlier. The judge was aware of all that, and he wasn't about to look like a patsy and agree to the defense's argument to reduce the charge to one count.

If this had not been a TV trial, the court would likely have never sentenced her to 4 years for lying to the police - and they also may have charged one count to start with - can you imagine every traffic stop, "how fast do you think you were going? did you see that sign? did you see me sitting there with radar? have you been drinking?" Here's your ticket for speeding ($100) and now you have to serve 5 years in jail for lying to the police officer 5 times! A different judge may consider the appeal valid.
