Human Embryonic Stem Cell Research Funding Can Go Ahead, Judge Rules

WASHINGTON -- A lawsuit that had threatened to end the Obama administration's funding of embryonic stem cell research was dismissed Wednesday, allowing the U.S. to continue supporting a search for cures to deadly diseases over protests that the work relies on destroyed human embryos.

The lawsuit claimed that research funded by the National Institutes of Health violated the 1996 Dickey-Wicker law that prohibits taxpayer financing for work that harms an embryo. But the administration policy allows research on embryos that were culled long ago through private funding.

U.S. District Judge Royce Lamberth, chief of the federal court in Washington, last year said the lawsuit was likely to succeed and ordered a stop to the research while the case continued. But under swift protest from the Obama administration, the U.S. Circuit Court of Appeals here quickly overturned Lamberth's injunction and said the case was likely to fail.

Lamberth said in his opinion Wednesday that he is bound by the higher court's analysis and ruled in favor of the administration's motion to dismiss the case.

3. Great news!
It's about time we move forward with this. To all Repubs I say: When this fabulous research produces cures for horrific diseases and conditions, you just hang on to your religious beliefs and refuse to be helped. After all, you don't "believe" in it. OK, good for you, but when the time comes, let's see you refuse a cure for yourself or say....your three yr. old grandchild who suffers from type I diabetes....tell him/her that God wants them to take daily insulin and suffer from the complications (eye, kidneys, vascular, etc) that this disease can bring not to mention the burden of daily maintenance on a child's life. Tell him/her that they can just suffer in the name of "right" because some "bad" people (science/medical researchers) used discarded embryo cells to create a cure and that you are morally opposed. What's the mantra? Just Say No! I'm saying yes...I'd rather save my child.

I could more sympathize with their arguments if most of these embryos weren't ultimately being discarded anyway.

6. Judge upholds embryonic stem cell research funds

A U.S. judge Wednesday upheld the government rules that allow federal funding of human embryonic stem cell research that might lead to cures for deadly diseases affecting millions of Americans.

In a victory for the Obama administration, U.S. District Judge Royce Lamberth ruled that the National Institutes of Health guidelines on such research do not violate a 1996 federal law, and he dismissed a legal challenge to the funding.

Lamberth had halted funding of the research a year ago. But he was reversed in a ruling by a U.S appeals court in April. His latest decision was mostly based on the appeals court’s reasoning and conclusions.

Opponents of human embryonic stem cell research, including many religious conservatives, have argued that it is unacceptable because it destroys human embryos.

7. it's impossible
to rationalize their thinking. They support embryos..well who doesn't..but once you're born forget it...you're on your own. How is that pro-life. :dilemma:
