Bid To Fire 'Pro Gay' Judges
Edited on Tue Apr-20-04 11:45 AM by Cannikin

(Boston, Massachusetts) Conservatives, thwarted in attempts to stop the scheduled May 17 start of same-sex marriages in Massachusetts, are attempting to exact a penalty on the justices who ruled gays have a legal right to wed.

State Rep. Emile J. Goguen (D-Fitchburg) has begun proceedings to have the Supreme Judicial Court justices who formed the majority opinion in the case fired. The court ruled 4-3 in favor of same-sex marriage last November. (story)

Goguen introduced legislation Tuesday in the State House to oust the justices. He says it is the best way to pressure members of the Supreme Judicial Court to reopen the case and reconsider the decision.

Goguen, 70, opposes both same-sex marriage and civil unions. Last month when a joint session of the legislature was considering a constitutional ban on same-sex marriage, (story) he voted against the measure because it would have allowed for civil unions.

2. Isn't this exactly why
we have Separation of Powers?? So that justices could rule without dealing with popular opinion??

4. See. This is what people mean...
when they say "remind me again what the difference is between the two parties?" Why are so many Democrats against the values like civil rights for all Americans?

The party has gone so far right it sometimes looks like an appendage to the repukes.

10. The issue is
and has always been Liberalism vs conservatism. Which philosophy works for the distribution of power (Liberalism) and which philosophy works for the concentration of power (conservatism). The label you wear does not matter. It's what you do that counts.

5. Are we going to ignore the fact that he is a democrat?
Thats the more important fact at hand. Shoots the whole religious right theroy in the knee. I say we oust him from the party. I think our tolerance for other views should stop at intolerance.

6. Not exactly a progressive one though.

According to CNN he was asked to do this by an anti-gay group (the Article 8 Alliance) "even though he is the measure's only sponsor".

12. I hear you
I suppose you could just about be a Democrat and against gay marriage/civil unions... if you stretched the concept really far and were very left on most other issues. But for a Democrat to wish to impeach judges for ruling a certain way on an issue, that is ridiculous.

8. What?! Because the judge won't rule with a biased opinion?
Edited on Tue Apr-20-04 11:57 AM by icymist
So get rid of them?! I can think of a couple of Supreme Court justices that, in 2000, rule with a biased opinion that maybe WE should begin to remove. Let's see.....according to MSN's Encarta encylopedia service,
http://encarta.msn.com/encyclopedia_761574302_1____20/Supreme_Court_of_the_United_States.html#s20

"Justices serve lifetime appointments. Under the Constitution they can be removed from the Court only by first being impeached (accused) by a majority vote of the U.S. House of Representatives and then convicted by a two-thirds vote of the Senate. There is no precise standard for determining whether a justice has committed an impeachable offense, though the consensus is that removal should be for criminal or ethical lapses, not for partisan political reasons."

Hey Thomas and Scalia....do you hear me?!
