Police, Occupy protesters clash in Oakland

By TERRY COLLINS
Associated Press

OAKLAND, Calif. (AP) -- Police and protesters supporting the Occupy Wall Street movement have clashed downtown following a day of peaceful protests throughout Oakland.

The confrontation began after protesters started a large bonfire in the middle of a downtown street. Dozens of police in riot gear moved in on hundreds of protesters as the flames leapt more than 15 feet in the air from several large metal and plastic trash bins that had been pushed together.

Police warned protesters to clear out before firing several rounds of tear gas and "flash bang" grenades to clear the area.

In the aftermath of the police actions, protesters with cloth wrapped around their faces to protect them from the stench of the gas rallied, chanting "Whose streets? Our streets."

24. Yes. Oakland does have history.
A history of of police "over reaction" which always leads to violence. Of course, setting the fire was stupid. I hope it doesn't hurt the rest of the movement.

11. Announcement: "15th & Broadway has been declared an unlawful assembly..."
Edited on Thu Nov-03-11 04:30 AM by Hissyspit
http://www.alternet.org/newsandviews/article/687459/are_california_police_departments_using_a_blatantly_unconstitutional_'order_to_disperse'

“I am (peace officer’s name and rank) a peace officer for the (name of jurisdiction). I hereby declare this to be an unlawful assembly, and in the name of the People of the State of California, command all those assembled at (specific location) to immediately disperse, which means to break up this assembly. If you do not do so, you may be arrested or subject to other police action. Other police action could include the use of force which may result in serious injury. Section 409 of the Penal Code prohibits remaining present at an unlawful assembly. If you remain in the area just described, regardless of your purpose, you will be in violation of Section 409. The following routes of dispersal are available (routes). You have (reasonable amount of time) minutes to disperse.”

I wrote about this from memory last week, but I grabbed the above text from the California Commission on Peace Officer Standards and Training's Crowd Management and Civil Disobedience Guidelines (PDF). So, reading this order before attacking a crowd is 'going by the book.'

Let's consider this text for a moment, and especially that phrase, "regardless of your purpose." Now, my purpose, as a working journalist, was to document a police action. I wasn't alone -- there were dozens of reporters on the scene.

I don't think one needs to be a constitutional scholar to understand that our "purpose" in Oakland that evening fell under the full protection of the First Amendment of the United States Constitution. We wouldn't be protected if we interfered with the police, but ordering us away from the area entirely and threatening us with arrest and potential bodily injury is blatantly, maddeningly unconstitutional. And this seemingly unlawful order is written right into the book.

14. the mayor of Oakland
Obviously has someones right wing hooksin her. She needs to be thoroughly investigated, and not by any government cover up agency. For this to happen after the Olsen incident means the police are giving her the orders, not the other way around. Anyone who doesn't see this as the work of provocatuers working in conjunction with the cops has their head up it. Someone has something on this mayor and they are using it. She needs to be exposed.

20. Note the time of the police action, and this post, just after midnight.
I think police were told to back off for 24 hours, for this one day, but to be prepared to go crazy after midnight.

With police from Richmond and Concord and other cities there, with tape over their badges and in unmarked vehicles, I think they were staged to move in at 12:01.

Just my guess.

17. of course this didn't happen during the day or greater part of the strike
I'm impressed that the disruptive assholes waited until around 11pm to start this shit. way to go black block/right wing stooges.

Now the local press has the only info it needs to completely condem what had been a surprisingly successful and peaceful general strike.

19. loud and clear
People need to speak out to the media about the history of police use of provocatuers and cointelpro. There is lots of documentation of such. Also, Occupy needs to be very aware and have groups ready on hand to nip provacatuers in the bud. Anyone advocating violence or engaging in these activities, carrying weapons, throwing stuff needs to be photographed, videoed and run out of the demonstration. It has been working well in other places. What's Oaklands problem?

23. oh how could I forget
The "patriot act" reversed all the limitations of the church committee and the deocratic president and congress we busted our rears to elect did zilch to restore our civil liberties. It is now Operfectly legal for law enforcement to infiltrate and disrupt church\political groups like OWS and disrupt/spy on with complete impunity. Occupy Oakland is apparently stuffed to the gills, and they are coordinating their disruption beautifully.:puke:
