Magistrate orders U.S. attorney to produce copy of binder used by key prosecution witness in trial

U.S. District Court Magistrate Judge Charles Coody this morning ordered U.S. Attorney George Beck to present for Coody's inspection a copy of a binder used by a key prosecution witness in the 2006 corruption trial of former Gov. Don Siegelman and HealthSouth founder Richard Scrushy.
A federal jury in June 2006 convicted Siegelman and Scrushy of bribery, conspiracy and mail fraud. Siegelman also was convicted of obstruction of justice.
Coody in his order said witness Nick Bailey used a three-ring binder to prepare for the trial, and that Bailey in an affidavit said he gave what he believed to be a ''true and complete copy'' of the binder to Beck, who at the time was Bailey's attorney.
Coody said he wanted to inspect the copy of the binder provided by Bailey, and he ordered Beck to deliver it by Nov. 10. Coody in his order did not say why he wanted to inspect the binder.
