Court Passes On Prayer, Potatoes
CBS/AP) The Supreme Court on Monday rejected cases concerning school prayer and Idaho potatoes, and ordered a lower court to rethink a decision on a state campaign finance law.

The Court said it will not consider reinstating mealtime prayers at a state-funded military college, turning aside an appeal from Virginia officials who wanted to preserve the tradition.

Justice Antonin Scalia blasted his colleagues for refusing to hear the case, arguing that it raised important church-state questions. Leaving those issues unresolved is unfair to VMI, Scalia wrote in a dissent joined by fellow conservative Chief Justice William H. Rehnquist. It takes the votes of four justices to agree to hear an appeal.

The high court forced VMI to admit women in 1996, as Scalia noted dryly in his dissent Monday.

"VMI has previously seen another of its traditions abolished by this court," he wrote. "This time, however, its cause has been ignored rather than rejected — though the consequences will be just the same."

1. I don't get the bit about the potatoes....
So a company in NY buys spuds grown in Idaho and packages them as "Idaho Grown" spuds.
What is the problem here?

And Fat Tony is a blot on the court.

9. Related article - interesting that Scalia and Rehnquist appear isolated
from the rest of the court. Of course we know that Thomas would agree with them. But this seems to signal that the two so-called swing-votes - O'Connor and Kennedy - may be feeling a little cross with their hard-right brethren.

11. Scalia must go
Every time Scalia opens his mouth, he digs himself into a deeper grave. He seems to have already formed a ruling on the case. I am anxiously waiting for the day that Scalia retires from the bench. It's about time some of the liberal justices stand up and open their mouths and put Scalia in his place. Tell him to "SHUT UP!", and maybe he would get a clue.

The justices give speeches all the time, and the more liberal ones have made several recently that were aimed in Scalia's direction.
