AP Exclusive: Nuke group reportedly to discuss settlement
Nebraska might be nearing a settlement in the case in which it has been ordered to pay $151 million for blocking construction of nuclear waste dump within its borders, The Associated Press has learned.

Nebraska has found itself running short on options to avoid paying the $151 million judgment it was ordered to pay for acting in bad faith in blocking the facility.

Earlier, a three-judge 8th Circuit panel upheld a 2002 ruling by U.S. District Judge Richard Kopf of Lincoln that the state acted in bad faith to block the compact from building the dump in Nebraska.

Nebraska officials argued that they refused to license the dump in 1998 because of pollution concerns.

1. Might Nebraska accept nuclear dump?
What could Nebraska possibly be offering to settle the lawsuit in which it's been ordered to pay $151 million for blocking construction of a nuclear waste site?

"There are two bargaining chips here," said Sen. Chris Beutler of Lincoln. "One is the likelihood that the U.S. Supreme Court would reverse" the judgment. "The other is our ability to locate a facility in Nebraska."

On Tuesday, the other members of the Central Interstate State Low-level Radioactive Waste Compact - Kansas, Oklahoma, Louisiana and Arkansas - rejected Nebraska's initial offer to settle the lawsuit. Details of the offer were not made public.

The compact commissioners ordered their lawyers to prepare a counteroffer.
