Stewart seeks new trial

Lawyers ask judge to toss conviction, citing perjury charges against government ink expert.

Martha Stewart Thursday asked a federal judge for a new trial, citing charges that a key government witness lied on the stand.

The request comes about a month before Stewart and her ex-broker at Merrill Lynch are to be sentenced for lying about a well-timed stock sale by Stewart in late 2001.

The motion follows perjury charges filed late last month against Larry Stewart, a U.S. Secret Service laboratory director, accusing him of falsely testifying that he carried out tests on a key document in the trial. Martha and Larry Stewart are not related.

3. The judge should not only throw out the trial, but acquit her on all
charges she was convicted of and bar any future prosecution on all other possible related charges. But what a fool I am hoping, thinking that we have a fair, if imperfect, system of equal justice under the law.

So she can go out and rip off our homes while she was decorating them or giving a dinner party and then lie when asked if she stole a fork? Heaven forbid..I wouldn't be safe! Martha needs to be in jail to protect the innocent public from her raping and pillaging of the USA. We won't be secure till Martha is stripped naked (with a German Sheppard outside her cell) in a high security prison with armed guards and razor wire. Ahhh! Then I'll be able to SLEEP again on my Martha Stuart sheets under my cozy Martha Stuart blankets...knowing we have a fair justice system and that no one is above the law...except George Bush.

8. Martha was the second high profile CEO
to do the perpwalk, right after Adelphia (which was run by a family, hence the term family first). Martha is a 'Hollywood type'. We all know how much Repubs hate 'Hollywood types'. Except for the Gropenator.

Here's a composite timeline of Martha's bigger contributions to the Dems and the investigation of her sale of the shares of ImClone Stock:

•1996 - $15K in donations to the DNC and Democratic candidates

•2000 - $10K to the DNC

•June, 2001 - Over $133K in contributions to the DNC, the Democratic Congressional Campaign Committee and Democratic Unity

•Dec. 26, 2001: ImClone founder Sam Waksal is tipped that the government will deny the company's Erbitux application, then tips his daughter to sell her ImClone stock and tries to sell his own.

•Dec. 27, 2001: Stewart sells all 3,928 shares of ImClone stock she owns. The government later contends she was tipped that Waksal was trying to sell his shares.

•Dec. 28, 2001: The FDA makes its decision public. On Dec. 31, the first trading day after the news, ImClone drops 18%.

•Jan. 7, 2002: Stewart's broker, Peter Bacanovic, tells Securities and Exchange Commission attorneys that he and Stewart had agreed on Dec. 20, 2001, to sell ImClone if it fell below $60.

•Feb. 4, 2002: Stewart gives the SEC, federal prosecutors and the FBI the same information about the $60 stop-loss order.

Do the math. She dramatically steps up her contributions to the Dems in June, 2001. On December 27, 2001, she makes a routine stock sale of less than 4000 shares of ImClone stock at approximately $60 a share, per her stop loss order with her broker. It's not at all unusual for people to review their portfolio at the end of the year and sell stocks that they consider "losers" so that they can claim any capital losses against their capital gains. On January 7, 2002, only 7 business days after Ms. Stewart's stock sale, her broker, Peter Bacanovic, tells the SEC that they had agreed on December 20th to sell ImClone if it fell below $60. If Bacanovic was already answering the SEC's questions on January 7, then that would have to mean that the SEC was already looking into the trade. Why it's almost as if they were MONITORING Martha's every financial move!

10. Bush insider trading four times the worth of Martha Stewart's
I just finished reading the book "50 Reasons Not To Vote For Bush". This has been taken from Chapter 37 - HARKENGATE -- Bush sold two-thirds of his shares in Harken (212,000 @ $4.00) "for a total of $848,000, about four times the worth of Martha Stewart's sale that has her potentially redecorating a federal penitentiary. Six months later, the stock was trading at barely over $1 a share. He took nearly eight months to inform the SEC of the sale, which came only weeks before Harken filed a quarterly report revealing that it had lost $23 million, something Bush did know about. One week before his stock dump, Harken lawyers warned Bush and others they could face insider trading charges if they sold their shares."...."Dubya (Bush) sold them anyway, knowing that he was above the law. Although an internal SEC memorandum concluded that he broke the law, he was never charged with any crime." .......... "Worst of all, most of this was publicly known before the 2000 election, yet was dismissed by corporate media...."
............So far, there has been, unsurprisingly, no new investigation of Harkengate. On Crossfire, the always colorful James Carville summed up the situation this way: "He thought he was exempt from the rules. He sold the stock and then he did not turn over the letter from the lawyers to the SEC until after the investigation was over. And I'm telling you that from the facts we know now, it appears we have someone guilty of insider trading sitting in the White House."

16. I would to see her get off.... I think this was a set up from the Good ole
boy network....They don't like tough business women who are successful......

I would go for something that was suggested...community service work...where she goes and teaches low income women/families....how to cook, decorate on their income.....

Forget jail....she did not do in peoples retirement funds.... or the SNL scandel of the other Bush brother.... or Harken... or Enron....

Again, the dem lies... a BJ in the oval office.. and her lie... .did not hurt millions of people.....

the repubs.....steal, hurt, torture, conive, and are downright mean spirted.....

And they get my anger going ...every day.... I am furious all the time....that they are getting away with all this 'crap' in our name and that they have 'crapped' all over our nation and continue to do so with the corporations.....

Martha is not evil from what I can tell..... Rich yes, succesful yes... get her into community service work with the poor and that could all change for the good....
