Jury deadlocks in videotaped rape trial
Monday, June 28, 2004 Posted: 10:12 PM EDT (0212 GMT)

SANTA ANA, California (CNN) -- A judge declared a mistrial Monday in the trial of three teenagers charged with raping an unconscious 16-year-old girl, after the jury announced it was deadlocked on all 24 counts against the defendants.

Defense attorneys and a middle-age male juror told CNN that 11 jurors voted "not guilty" on two counts of rape by intoxication and two counts of oral copulation by intoxication. The breakdown of the jury's vote on the other charges has not been revealed.

The defendants -- 19-year-olds Gregory Haidl, Keith Spann and Kyle Nachreiner -- are charged with three counts of rape by intoxication, two counts of oral copulation by intoxication, 14 counts of sexual penetration by intoxication, three counts of penetration by force, one of penetration by force in concert and one count of assault with a deadly weapon.

Throughout the trial, defense attorneys presented jurors with a different characterization of the teenage girl, describing her as promiscuous and an aspiring porn star who was acting out her fantasies and agreed to be videotaped.

2. This is so touching -NOT
"When the judge declared a mistrial, Haidl sobbed as he walked outside the courtroom to greet his parents. His father, Donald Haidl, the assistant sheriff of Orange County, also wept as he hugged his son"
There is something wrong when an officer is happy when a criminal gets off - even when it is his own son.

important facts that the reporter is leaving out.

How can you give consent when you are unconscious?

Does a mistrial mean that the prosecutor can try them again? Maybe the story isn't over yet.

4. I know
This is disturbing. Did someone threaten the jury? How can people be that insensitive? Either they were threatened, or they're afraid to get involved.

15. There was a question of whether she was unconscious or not
This trail is discussed by KFI in Los Angles every day on the John and Ken show. I don't like the show it is on but I listened in a couple of times. The girl looks unconscious in the video but I guess it wasn't proved to some jurors.

10. I do not condone at all what the boys did
but I also do not condemn the father for hugging his son at a time like this

Let's hope that the son is learning a lesson

It was a mistrial so the prosecution can try the case again

6. Oh, Yeah, She Wanted This
Prosecutors allege that the teenagers gave a 16-year-old Rancho Cucamonga girl - identified in court only as "Jane Doe" - a drugged drink in July 2002. They then allegedly sexually assaulted her with a pool cue, juice bottle, juice can and lit cigarette at the Corona del Mar home of Haidl's father, Orange County Assistant Sheriff Don Haidl.

7. I'm sure its entirely coincidental that it was in the A. Sheriff's home
I'm sure that had absolutely NOTHING to do with the mistrial.

11. "as she lay motionless on the pool table"
How the fuck can this NOT be rape?

I went to high school in a town just like this. I can tell all kinds of nasty stories of the football team beating their girlfriends, date rape, etc., and no one EVER got punished for it. This story stinks, and I guarantee you it had something to do with their daddies' connections.

12. Please tell me . . .
that if they re-try this case it will be in a different venue than the Sheriff's home town.

16. Good news (I guess)
http://www.cnn.com/2004/LAW/06/29/video.rape.trial/index.html

I doubt it will have a different result, having grown up in towns like this, but I naively hope that someone will face justice because of this.
