Gay-suit petition by GOP berated

A Thurston County Superior Court Judge yesterday blasted 22 Republican lawmakers who sought to intervene in a lawsuit against the state over gay marriage.
Saying the "train has left the station" in this watershed case first filed in April and set for a Sept. 2 hearing, Judge Richard Hicks told the attorney for the seven state senators and 15 representatives that allowing them to enter now would be disruptive.

His decision is a significant blow to conservative lawmakers who, acting not in their official capacity but as private citizens, worry that Attorney General Christine Gregoire won't vigorously defend the state's Defense of Marriage Act, which defines marriage as between a man and a woman.
The lawsuit by the American Civil Liberties Union on behalf of gay couples from around the state is the second filed in Washington state this year challenging the constitutionality of the act.
In March, several King County gay couples sued County Executive Ron Sims after they applied for and were denied marriage licenses.
