Fla. Judge Delays Voting Machine Lawsuit

By ADRIAN SAINZ, Associated Press Writer

FORT LAUDERDALE, Fla. - A judge ruled Friday that a lawsuit demanding that Florida's touch-screen voting machines produce a paper record will not be heard until Oct. 18 — too late, perhaps, to affect the November presidential election.

An attorney for Rep. Robert Wexler (news, bio, voting record), who filed the lawsuit, conceded that since the trial will not begin until two weeks before Election Day, the touch-screen machines used in 15 Florida counties will probably not be fitted with printers in time for the balloting, even if U.S. District Judge James Cohn sides with the congressman.

"It's probably too late now, " Jeff Liggio said.

But Liggio said the judge would have other options if he rules for Wexler, including requiring the state to order monitors to oversee the touch-screen machines or have the 15 counties switch to optical scan paper ballots.

2. How about ordering them to use plain paper ballots?
There's plenty of time left for those.

4. What possible reason could the judge have for ordering that?
Think about it from a management standpoint. Imagine you work in a large company, and you have a really big product you are rolling out on November 2nd. One of your employees comes to you and tells you that there may be a problem, and the product may be completely defective. In fact, your competitor may be TAMPERING with your product (for the purposes of this analogy, "your competitor" is anyone seeking to disrupt the democratic process).

You leap into action, and schedule a meeting to talk about the issue. Then you set up a timeline that guarantees that the issue will NOT be resolved by the ship date for your new product. Your ass would be on the unemployment line before you can say "Sigma 6".

6. Good points. An appeal should be made
It seems there is a great deal of public interest in the balance.

5. It's too late for honest elections? I think NOT! This should be brought
up to the Supreme Court...Honest elections or NO elections! If Florida cannot produce a paper trail like an ATM machine does that drops into a ballot box that is sealed, than Florida should lose the 25 electoral votes...PERIOD.
