El Paso judge says state can't prohibit sales of sex toys

EL PASO, Texas — The case against an adult novelty store employee accused of displaying sex toys was dismissed on Monday by an El Paso County Criminal Court judge.

Judge Alma Trejo granted a defense motion to dismiss the case against Sergio Acosta, manager of Tres Equis in El Paso. A spokesman for the El Paso County District Attorney's Office said the ruling will be appealed

Roger Jon Diamond, who represented Acosta, said he is prepared to pursue the case as far as necessary to challenge the law. He said the state appeals court relied on a U.S. Supreme Court ruling that has since been reversed.

Diamond argued that if a person can legally use a sex toy at home, it must be legal to sell it. Prosecutors argued the opposite, that although it's legal to use a sex toy at home, that doesn't imply the right to sell it

Couple Charged For Alamo Sex Romp

SAN ANTONIO (AP) Some tourists are sure to remember their trip to the Alamo. San Antonio police arrested a couple who witnesses say were having sex at the shrine of Texas independence Sunday.

A police report says the 18-year-old woman and 19-year-old man were caught by an Alamo security officer after several visitors complained.

The two people are said to be soldiers stationed at nearby Fort Sam Houston. The San Antonio Express-News says they face a charge of public lewdness.
