Ex-CIA contractor may face December trial

ELIZABETH CITY, N.C. -- A former CIA contractor charged with beating an Afghan detainee who later died may be tried as early as December, a federal judge ruled Wednesday.

U.S. District Court Judge Terrence W. Boyle set a target trial date of Dec. 13 for David A. Passaro, 38, who is charged with four counts of assault stemming from the beating of Abdul Wali at a U.S. military base in Afghanistan in June 2003.

Prosecutors say Wali died after two days of interrogations and beatings by Passaro, a former Army Green Beret working as a contractor for the CIA at the base. Prosecutors have said three paratroopers from the 82nd Airborne Division will testify that they saw Passaro beat Wali.

Wali was described as having participated in rocket attacks against a U.S. base located in mountainous northeast Afghanistan near the Pakistan border.

Passaro once was a Hartford, Conn., police officer, but was fired before his probationary period was over after he beat up another person.
