US Court Upholds Bush Appointment of Abortion Foe

ATLANTA (Reuters) - A U.S. appeals court ruled on Thursday that President Bush was within his rights to appoint former Alabama Attorney General William Pryor to its bench while the U.S. Senate was on a five-day recess.

In an 8-2 vote, the 11th Circuit Court of Appeals rejected Democratic Sen. Edward Kennedy's argument that the appointment during the President's Day break in February violated the Senate's right to confirm or reject federal judicial nominees.

The president is permitted to appoint federal judges without Senate approval when it is out of session. <snip>
