Court: Terror War Can't Curtail Liberties

ATLANTA - Fears of a terrorist attack are not sufficient reason for authorities to search people at a protest, a federal appeals court has ruled, saying Sept. 11 "cannot be the day liberty perished."



The 11th Circuit Court of Appeals ruled Friday that protesters may not be required to pass through metal detectors when they gather next month for a rally against a U.S. training academy for Latin American soldiers.

Yeah, those dammed judges who actively protect the Constitution.

5. I get the impression lately some judges be they R or D are
getting pissed off at Shrub trying to legislate law all on his own.

9. No, it's not conservative
Except for the right wing judge Bush just put on the bench there via executive order when the senate was on break.

They're not a liberal court, but far from reliably conservative either. Remember, in 2000, the Bush team skipped this court and went straight to the Supremes. They SHOULD have appealed the Florida decisions to this body and didn't. There was a reason for that - the bench wasn't reliably on their side.

7. Worries me, too.
Especially if we end up with another four years of the Naked Emperor first, and he puts another activist judge on the court like Long Dong Silver or Orgy Boy.

regarding US Constitutional rights. Hope the word gets out that some courts regard the Constitution as crucial to preserving Democracy.

"We cannot simply suspend or restrict civil liberties until the War of Terror is over, because the War on Terror is unlikely ever to be truly over," Judge Gerald Tjoflat wrote for the three-member court. "September 11, 2001, already a day of immeasurable tragedy, cannot be the day liberty perished in this country."

especially Bu$h and the PNAC. There is nothing that Bu$h and the PNAC would like more than for innocent people to be stopped and searched by the police as often as possible.

Once John Kerry is elected all of this craziness will begin to disappear, and eventually we will no longer have to worry about terrorism ever again (except domestic terrorism from neo-nazi like freepers.

If Bu$h stays in the WH, every day in America will be a day of fear fueled by blood thirsty, profit oriented corporate warmongers bent on using fear to control our country.
