Limbaugh appeals ruling that supported medical records seizure

WEST PALM BEACH, Fla. ? Rush Limbaugh appealed a state court ruling on Thursday that would allow prosecutors to examine the conservative radio commentator's medical records for a criminal investigation into his use of painkillers.

Limbaugh maintains that he has committed no crime and that the seizure of the records violates his privacy.

Attorney Roy Black asked for a rehearing by the same three-judge panel of the 4th District Court of Appeal or by all 12 of the appeals court's judges. It also seeks additional review by the Florida Supreme Court.

"Patient rights are not protected by holding secret proceedings where only the prosecutor attends," Black said in the legal filing. "Florida's medical privacy statutes afford all patients the right to be heard before their medical records are seized."

Investigators raided Limbaugh's doctors' offices last November to see if Limbaugh had engaged in "doctor shopping," or illegally visiting several doctors to receive duplicate prescriptions.

Limbaugh has not been charged with a crime and the investigation is at a standstill pending a final decision on the medical records, which prosecutors have not been allowed to review.

7. I thought they also had sworn testimony and e-mails from Rush
What was the deal about his housemaid bringing him drugs and scoring drugs at Denny's? I was under the impression that the Prosecuters had sworn testimony and I believe even some tape recordings and e-mails as evidence. Has that part just been dropped? Why has the investigation stalled? this was a totally different part of the original charges if I am not mistaken.

9. I don't think that relates to this...
If his housemaid was "pilling him up", then that wouldn't be related to the doctor shopping issue, since she wouldn't be getting him the stuff by doctor shopping, but rather through the black market.

The court's ruling is very scary. Where is the privacy right? Even the ACLU stood up for Rush on this issue.

Forget who is involved and what a pig he is, think of the repercussion of this precedent. Honestly we should all be very concerned regardless of who the centerpiece is.

but in this case I'll make an exception.

This is the guy who wanted drug users thrown in jail for life, drug dealers executed, all that jazz. Then the fucker shows up taking enough OxyContin to euthanize the Budweiser Clydesdales. And he was buying the shit on the street, which means, in the argot of the Justice Department, that Rush was supporting terror with his personal habits.

I have no problem with search and seizure warrants. The Right to Privacy does not and should not shield you from the consequences of criminal activity. Rush admitted ON AIR that he had abused prescription drugs. This fact combined with the allegations against him clearly meet the requirements for probable cause.
