CNN BREAKING: Fed Appeals Court overturns 100 death sentences

... in the state of Arizona and elsewhere, because the inmates were sent to death row because of judges, instead of juries. The appellate court in San Francisco turned in this decision.

ON EDIT:

I'm confused... I thought judges usually handled the penalty phase, but that there was another ruling handed down related to this issue not too long ago. Maybe one of our Legal Eagles could clear this up for us?

I hope not -- the Right loves to attack 9th circuit; other circuits aren't as easy to bash.

Still...sounds like a good verdict!

6. 9th Circuit a model for nation.
Hopefully some day the Supreme Court will be modeled on the 9th Circuit. It's really only a matter of time. The thing about conservatives, is that they're mainly engaged in heading off progress, but find it extremely hard to roll back progress.

5. I believe that the 9th circuit has
no choice. this decision was made and has precedent in the supreme court.

7. I'm glad they made the decision...
...I just would love to see other circuits make similar ones. It would dilute the "California whacko" label the Right tries to slap on every one of their decisions.
