.. The legal basis for the eavesdropping program is extremely fragile, given the restrictions that are clearly spelled out in the FISA statute.

But quite aside from these legal questions are legitimate concerns about the judgment of anyone who oversees and champions a program that, without the permission of any court and without meaningful oversight from Congress, potentially intrudes upon the privacy of countless Americans.

Hayden's intimate involvement with the wiretapping raises questions not only about his judgment but about his willingness and ability to provide independent counsel, free of political or other considerations.

If the CIA is to be any good at all, it must be a reliable and independent source of information and analysis. Hayden vowed to the committee on Thursday that he would not be a yes man. But his ample record as NSA chief and his testimony before the committee do not support his assurances, however emphatic and sincere they were ..
