Man Falsely Jailed For 20 years

Charges are to be dismissed today against a 39-year-old Goldsboro man who has spent nearly two decades in prison for a 1987 rape.
DNA testing has excluded Dwayne Allen Dail as the man who entered through the window of a Goldsboro home and raped a 12-year-old girl in 1987, Wayne District Attorney Branny Vickory said late Monday.

Vickory got the test results from the State Bureau of Investigation on Monday afternoon and plans to ask a judge to dismiss the charges against Dail today.

"The science has proved that Mr. Dail is innocent," said Vickory, who worked in the district attorney's office when Dail was prosecuted. "He didn't do it. The evidence is so overwhelmingly strong, there's no need to wait."

The exoneration follows a lengthy inquiry by the nonprofit N.C. Center for Actual Innocence, which uncovered evidence that authorities thought had been destroyed after Dail's trial.

the media and many people here were all over them, proclaiming them guilty. And it took nearly a year and millions of dollars in attorneys fees before they were declared innocent.

Yes, they didn't go to prison. But their own high-priced attorneys admitted that that was largely just a matter of luck -- even with all that expensive legal advice. If a few key events hadn't gone their way, they could have wound up in prison for decades for a crime that an accuser had just made up.

7. I am as big of a defender of the Duke students as anyone, but this case is worse
The Duke boys had the money to fight back, and they never saw a jail cell. And justice was done to their persecutor-prosecutor.

It appears that this man here did not have money and connections to avoid having 18 years of his life taken away from him. Now I am twiddling my thumbs here wondering who will be held accountable for this outrage. Or is the state going to just say "Oops!" and carry on like nothing happened?

8. I won't argue that -- this case is certainly worse, by far.
And there is no amount of money that will give this man his 18 years back. What a tragedy.

2. The DA, the cops, the judge AND the jurors who put him through this should pay
And Mr. Dail should be paid so much money that he never has to work another day in his life.

It would be another injustice if he had to spend the rest of his life digging ditches or waiting tables for the rest of his life because he was not able to acquire an education or job skills.
