Brother's arrest like "slavery times"
On Feb. 22, my brothers were enroute to my home in the Village of Tuxford. We are black, tax-paying Americans who should be able to live and drive anywhere in the United States. My brothers were stopped by the cops, and they did have an expired tag on their car, and this is against the law. My brother who was the passenger in the car had just been released from the Veterans Hospital that same day after having had open heart surgery about three weeks earlier. He also has had a leg amputated, and so is totally dependent on a walker. Nevertheless, he was taken out of the car and made to sit on the cold, wet ground while being accused of the break-ins in the area. From there, he was taken to jail and put on the cold floor. When I got a call from the jail informing me that he was so sick and did not belong there, I left my house alone at 2 a.m. When I got down to the jail, he was standing outside without a coat and without his walker. I wanted to cry, and I probably did.

He had a fine for a traffic accident on the books downtown and had a receipt in his pocket that he showed the officers, but they kept insisting that he was the robber. My brother had to be readmitted to the hospital and he's in the intensive care unit. I am also afraid, and I want the criminals caught, too, but what I don't want is an incident for "driving while black in Springhurst."

I have another brother who visits me from Indianapolis. He's 62. Is he also going to also be arrested like the 58-year-old? I want the City of Louisville, the State of Kentucky, the United States and the world to know about this incident. It's like going back to slavery times.

1. "Fit the description"
I wonder if they were told that they "fit the description" of the suspects. Is this area a predominantly white area?

It's horrible to see this sort of behavior occurring anywhere.

some years ago the harlem globetrotters did an exhibition game in santa barbara, ca... you can guess the rest. after the game, some of the team members were walking state street, IN THEIR GLOBETROTTER WARMUPS, and the next thing you know they were facedown handcuffed while the local officers were telling them they fit the description of a burglar.

yikes. santa barbara? everywhere

2. How awful for you and your brother!
I'm so sorry. There are so many assholes and they seem to congregate in police forces.

Write a complaint and contact your local paper. I think it does very little but it may give the next cop a slight pause if he knows he may be asked to justify his behavior.

3. For 140+ Years
since the black men and women have been given their freedom in this country, whites have sought ways to keep them down. This type of treatment is blatantly wrong and should be a crime if it isn't. However, an expired tag gave the police all the excuse they needed. Keep your shit straight and you're less likely to have problems.

13. They always have some excuse ready.
A black coworker of mine ran out for dinner one evening when we were working late and was pulled over by two Arlington, VA deputies who claimed his car (a newer BMW) had been reported stolen. They proceeded to harass him with a stupid, rude and racist interrogation, searched his car and his food, by hand (for drugs, of course), then, when they'd had their fun and realized he wasn't going to do anything that would give them an excuse to arrest, tase, beat or shoot him, they simply left.

Though I expect this type of situation happens far, far more often to black people, I couldn't be much whiter and have had or been witness to several such - and even more bizarre - encounters with police of various local, state and federal agencies over the past few years.

Given the current general, fascist tone of the nation, I expect it to become a whole lot worse before it ever gets better again. I agree with the other poster about keeping your shit legal and in order and would add that limiting your exposure to law enforcement, in every circumstance, is probably a good idea. The tone is being set from the top, and if setting someone up is perfectly OK for the pResident, his minions and the top law enforcement agencies in the country, there's no reason to think Gomer, Buford and Enos wouldn't want to get in on some of that action too.

4. Interesting analagy.........Considering your circumstances and
the physical disabilities I would think the ACLU would be helpful, but maybe not. I live in a small village too. But our analogy here is that we get stopped while driving under the influence of being against this war......

To a lot of cops, it seems that disability is twice as much excuse to fuck you over. Just ask the sheriff's department in Tampa, FL.

There are good cops, and then there are cops who get their jollies by preying on the weak, knowing that prejudice in society will make it unlikely they will have to pay for their misdeeds. We must combat official oppression both by demanding that police departments clean up their acts, and by we civilians cleaning up our own. No bigotry, no excuses.

9. If this was the Louisville PD - well, they've had their problems!
I personally know people who were beaten up by the cops there with no just cause or provocation.
One friend defended himself and knocked the cop out. Even though he was arrested, the city dropped charges. My friend turned around and sued the city for $1.00 and the cop's job. He won in court.
When the judge decided against the cop, taking his badge, the former cop jumped up in the court room pointed at my friend and said "I'm going to kill you M.F.!" The judge had him thrown in jail for 30 days and also gave him 5 years probation.

10. That is an outrageous injustice. As a Kentuckian who lives in Louisville,
I offer my most abject apologies. This should be reported to the mayor immediately and should be investigated to the max. A suit is also probably in order. We citizens (I am white, but what difference does that make?) have had enough.

What if just hypothetically, you had spoken out against the government or exposed government corruption. Then you’re pulled over by police and they look at your driver license and say, “Yeah that looks like the guy.” You are arrested and taken downtown and booked on a charge of conspiracy to distribute cocaine.

You protest your innocence but in court the police testify that although they did not find any drugs on you. They observed you holding plastic bags that they believed had drugs in them and found a cache of 50 vials of crack under a stoop half a block from where you were sitting.

You explain in your defense, you have no connection to the drugs, you work for the city and they think highly of you. You have no criminal record other than a teenage arrest for fighting. Your employer comes to your defense and testifies under oath that you were at work when the police supposedly saw you with those bags.

Surely, you couldn’t be convicted on such spurious charges could you? No connection to the drugs at all and the only evidence against you at all is a policeman who said you were holding baggies that might have had drugs in them. Could you go to jail in America on such charges? Land of the free home of the brave? Of course not! With our system of checks and balances you couldn’t possibly go to jail just because a policeman said so.

So then they charge you again and arrest you again! Despite the fact that a jury could not reach a decision in your first trial. Despite the backlog in the courts and the cost to the community. Despite your personal history of gainful employment and no criminal record in your adult life a prosecutor thought that the merits of the case called for a retrial.

Then you’re convicted in your second trial.

In August 2006 Fred Curry of Baltimore MD video tapped the arrest of his Uncle Wayne Curry on the street by Baltimore police. Wayne Curry is standing handcuffed next to a police car, he is struck and thrown to the ground then violently dragged back to the police cruiser. When the video tape surfaced it caused outrage in the black community for like so many of these video’s the policemen involved where white and the suspect was black and in handcuffs and unable to resist.

Fred Curry was arrested during a drug sweep when according to witnesses police arrested him only after his identity became known. The witness Sheldon Richburg testified under oath, “They asked him what his name is, and then they handcuffed him and said, ‘We’ll do you like you did us,’”

Curry’s first trial ended in May with a hung jury and Attorney Granville Templeton said, “Clearly they want to get him out of the way; the drug charges his client faces are retaliation for his involvement in making the tape that embarrassed the department.

But during his second trial the judge, Baltimore Circuit Judge Albert Matricciani issued a gag order during the trial and barred Curry’s attorney from mentioning the videotape during closing arguments or speaking to the media. Templeton argued after the verdict the video was crucial to his case.

Now why would the judge do that? The crux of your defense is that you are being maliciously prosecuted. The police find no drugs on you, witnesses testify you were not in the area when the police claim they saw you with baggies. Witnesses testify that the police even said, ‘We’ll do you like you did us,’” but without the ability to present or even mention the video what defense does Fred Curry have?

Fred Curry, 36, was found guilty of possession of cocaine with intent to distribute and conspiracy to distribute after two hours of deliberation by a city jury. Both crimes carry a maximum penalty of 40 years in prison. Sentencing is scheduled for Oct. 10.

Margaret Burns, spokeswoman for Baltimore City State’s Attorney Patricia Jessamy, applauded the verdict. “This case is an example of how a thorough police drug investigation can yield a significant conviction and substantial jail time,” she said. “The prosecutor worked closely with police detectives in a partnership that benefits public safety.”

This is no more justice than a Gestapo arrest and the only thing the prosecutors proved was that they couldn’t win the case without denying Fred Curry the tools to defend himself. The streets of Baltimore are no safer there are no less drugs or drug dealers loose on the streets. The only ones made safer are the thugs in government, I said thugs and I mean thugs whether you swing a billy club or a gavel the American revolution was meant to protect us from them not by them.

That freedom of speech against the government is the most essential and only one worth having for anything else is faux freedom. A sugar coated illusion for elementary school textbooks and the minds of idiots.

The citizens of Baltimore owe Fred Curry not only an apology but also a thank you for exposing police brutality. A brutality that will never get better by itself and extends to the highest levels of the judiciary.

Casey, the preacher in Steinbeck’s novel The Grapes of Wrath explaining why he was under arrest smiled and answered, “Because I talked back!”


Somebody needs to go to jail for 40 years but it’s not Fred Curry.

The investigation of the police department cleared them of all wrong doing.

15. Driving While Black Or Victim While Being Black
Hi. I am hoping that you email me about this. I have a similar story to share with you, only while I was driving in a very bigoted town that I have gotten stuck in, a tourist came here, a white male, and struck my vehicle. The white cop, from a police force that has harassed me since I have moved here, refused to cite the white at-fault, but did cite me for not having insurance. He later learned that I did have insurance, the next day, but he refused to release my vehicle from the Tow Yard. Weeks later after my vehicle had been in tow storage did he finally release it and by then the fraudulent towing company also owned by bigots had racked up many thousands of dollars in fraudulent towing fees. Though tow new towing bills had been passed last year, the police, of which ODOT stated they were responsible for investigating the fraud of the towing company, refused to take any necessary action. It's been an upheavel and I am disabled also, and African American.

I can honestly say that I never used to hate anyone but since moving here to Oregon, I question that very thing everyday. Now I have turned it over to the U.S. Attorneys Office and to the Civil Rights Division here in this state. Don't move to Oregon if you are Black and expect to live freely. The white to Black population ratio here is 94.14% to 2.38% and the bigoted, ignorant mentality here is overwhelming by Whites. I'm sure not all are bad, but it's pretty much the gist.

The last time I checked on Obama's percentage rate here for voters it was 28% to Shrillary's 36%
