In removing the restraints on corporate check-writing, the Court's majority was not focusing on the real world, but on a theory. And it did not even get that right. Its theory is that corporations should have the same rights as individuals — a theory that makes sense only if you don't think about it ...

That is a crucial thing. A corporation cannot vote. And the American people decided as far back as 1907, when Congress passed the Tillman Act, that a corporation should not be free to use its money to influence how citizens vote in national elections. In one way or another, the federal government has undertaken to restrict corporate influence in elections for more than 100 years ...
