An Indefensible Defense

It can be hard to distinguish between the Bush administration and the Obama administration when it comes to detainee policy. A case the Supreme Court agreed last week to hear, Ashcroft v. al-Kidd, is one of those occasions.

2. a classic example -- once a branch of government has a power, it doesn't just give it up
regardless of party, and regardless of whether or not obama ever would have initiated this particular power.

this is why the framers created a system of checks and balances, which party power and money have almost made irrelevant.
