If it is then I think the Administration must come back to Congress from time to time at least to "inform" Congress of what is going on. I doubt any other country could be invaded "Pre-Emptively without another resolution. I think Congress may be just a bit more skeptical now-a-days.

That's an interesting thought, but fortunately they don't have the resources to do much.
That's why they're looking at just jumping in on the Israeli side and bombing the Syrians. Which is, frankly, something only an insane prerson would suggest.
