1. I don't think it was asserted that he was drunk...
and anybody convicted of a felony is a felon, regardless of sentence.

3. Even if he gets less than a year in prison?
I always thought felonies were based on sentencing.

in the county jail... he would be ripped apart in prison, the prison he spent yeas making so nice instead of our schools... he will be set loose after 100 days to start a 3 year probation period... if he gives up his liscence for those 3 years and pays back the county for their expenses on him... the felony account will be erased from his record, which means he will be able to practice law again... which is bullshit, he killed a guy, afterall. this crap is all over my local news, it happend a bit north of where i live... so... we hear about it all the time, if we want to or not...

he blew though a stop sign.Unless he gets separated from the general prisoner population this could be his last 100 days on this planet, or at the very least 100 days of D.A.R>!

5. I'm not laughing
With Janklow's record he should have gotten some serous jail time.

I heard a rumor that because of the leniency shown Janklow over killing a biker, that there is a movement to boycott Sturges.

I'm not an attorney, but my understanding is that a felony is a crime for which the maximum sentence is more than a year in prison. Not that if a person gets less than a year, the crime therefore wasn't a felony.

10. You're still a felon for this charge regardless of the sentence
Local jail time is often tacked on to probation in felony cases. Especially for first-time offenders. He has a felony conviction for which he was sentenced to 100 days in the county jail, followed by the remainder of his 3-year probationary term. If he screws up on probation the prosecutors can petition the court to revoke his probation and ask to have him re-sentenced. If that occurs (and it can, even for a minor offense, but normally is not unless the probationer keeps screwing up) all bets are off and the judge can sentence the fat, lying pig-f***er to prison, where he belongs.

9. It's a felony, even if he gets probation.
Generally speaking, any crime for which you can be sentenced to a MAXIMUM of 364 days in jail is a misdemeanor; a felony is one for which the sentence is one year, or MORE. However, not all felonies require that you spend time in jail, because some are probationable offenses.
