Can We Still Hold Saddam If We Can't Find The WMDs??
Legally, I really don't think that we can. He may have committed crimes against his own people, but he hasn't really violated any international laws. Now, he can be tried by his own people for crimes, but we have no case against him if we can't find WMDs.

2. Its a good question....
the interesting thing is: his country was invaded...illegaly.
How can he be a POW when he was on the defensive? The conquerors
have him in a jail (or so we are told...).
Either way: remember the the initial "reason" that the US invaded
was because Saddam had nukes and other nasties...and was becoming
an "immediate" threat.
Well, why hasn't the US pulled out...? Ahhh...there be the question.

7. Theoretically....
yes. What's more, once a legitimate Iraqi government is setup, the
people of Iraq could place their grievances before the International
Crimes Court and request that shrub and co. be brought to trial.
Whether this actually is PERMITTED to happen remains to be seen...

3. Legally you must be talking about some other country
legally we are responsible for the deaths of thousands of people by conducting an illegal and aggressive war in direct violation of the U.N. charter and the Geneva convention. To put it more simply for the repugnant lurkers Bushco are all war criminals.

6. There's still the human rights violations correct?
I thought that was the main reason he was being held and the main reason the Iraqi's want to try him themselves. The Iraqi's don't want the * regime to interfere with their claims against Saddam.
