17. Actually, it is a threat.

In South Carolina, for example, only a "minister of the gospel" is authorized to perform marriages. If it became widely known that Christian ministers and ONLY Christian ministers are allowed to perform marriages in South Carolina, somebody might get the idea that every marriage ever performed in South Carolina is constituionally null and void. So any argument concerning rights vis-a-vis marriage is a threat to South Carolina marriages.

Ditto several other states which limit this authority to Christians and Jews. All of the non-Confederate states allow secular marriages as well, of course. But I suppose one should applaud the old Confederate states for at least being decent enough to permit Jewish weddings.
