What does the law say about Hermaphrodites getting married?

Marriage is defined as between a man and a woman but what if someone is born with both a penis and a vagina? What does the law say about them? It seems to me that because this happens in nature this is indisputable proof that nature is not perfect as people can be born with both sexual organs. So if people can be born with both sexual organs then why can't they be born with the soul or hormones that are not associated with there sexual organs? In other words have the physical appearance of one sex but the soul of the other. Chemicals cause Hermaphrodites to have both sex organs and chemicals (hormones) cause people to have different kinds of sexual attractions. It's easy for science to show that sexual orientation is not cut and dry just as the physical make up of hermaphrodites makes things anything but black and white. This in my opinion would force the law to have to reexamine what determines if a person is male or female. Is it physical anatomy or psychological chemistry? I think it's quite clear based on the natural occurrence of Hermaphrodites that sex is not determined by physical attributes but by body chemistry which is extremely complex. I wonder why the ACLU or lawyers have not argued for Gay marriage using the example of Hermaphrodites who could be described as both male and female throwing a wrench into the traditional way of determining marriage laws which don't address this. Anyone have any thoughts?

Not that I'm an expert after watching a couple of documentaries, but I think doctors assign them to a gender at birth according to what genitalia appears "dominant." Of course, there's the high likelihood that they get it wrong.

I'm not sure if "assigning" a gender is so much of a problem as physicians performing surgery according to this assignment. In fact, the medical profession has gotten it so wrong in the past that there are hermaphrodites who are largely against these surgeries, advocating that hermaphrodites have the right to choose their gender on their own. How that works on paper would be interesting to know.

But I'll betcha it's as regressive as any policy toward those who don't fit the stereotypical category of male or woman, and of course, hetero.

Oh, and there's a fictional book out about this very topic..... Middlesex by Jeffrey Eugenides. Once you get past all the family history in the book, it's pretty good.

to say what's in there panties. I see it the other way around. What if people with big noses were considered freaks and didn't want the government to know what their nose looked like. That seems rediculous dosen't it? So if someone has a sexual organ that society is prejudice against then it's really society that has the problem.
