Poll question: If a crime is committed by conspirators is each participant responsible? |
|
Let's also say that the outcome would have been impossible with out every single actor, without one of them there would have been no crime.

1. You are guilty of "Framing the Issue" |
|
You have completely ignored factors like "intent" and "motive". Without those, your question is meaningless. You also left out any mention of whether the acts performed by the co-conspirators were illegal or if they knew of the goals for the conspiracy

2. Since it was a criminal enterprise, intent and motive are assumed. |

3. This is a legal question dependent |
|
upon the crime, the jurisdiction, the intent of the co-conspirator, and the criminal code in place.
Accordingly, no answer is possible.

5. They conspired to commit a crime... which is a crime in and of itself... |
|
Ergo, if they all conspired to commit, whether or not they actually carried out their intent, they committed a crime in conspiring to do so.
