Do I have a case against Rush?
Edited on Fri Apr-09-04 07:50 PM by maxrandb
The other day I was driving with my 10 year old daughter in the car. Looking for some traffic and weather, I switched the radio to the local AM talk radio station and heard Rush saying that (and I'm paraphrasing here), Dems are hoping for more people to lose their jobs, and wishing for more of our troops to get killed in Iraq, because it is the only way they can win politically.

Forget about the stupidity of his statements and arguement for a minute, I could shatter it full of holes in seconds by pointing out that simply because the Dems want to improve the economy, and have a beter idea about how to win the war on terrorism, means that they DO NOT wish for bad economy or more death in Iraq.

What really made my blood boil is that I am an active duty military member and my daughter also knows that I am a proud Democrat. She turned to me and said, "Dad, you don't want more soldiers to get killed in Iraq, do you"? I assured her that was not the case and that if that idiot spewing hate on the radio were within my grasp I'd have ripped his tits off. Ok, I didn't really tell her THAT, but I did make it clear that he was just a stupid idiot.

My question is, should I file a complaint with the FCC? If pigboy is not obscene, I don't know what is.

19. If individuals can file lawsuits over the trauma
they suffered as a result of Janet Jackson's wardrobe "malfunction" (and some have) I would think you can find a lawyer to take your case. What's more there was the trauma to your child.

4. I'd say try it
But I'm sick to death of their statements that liberals hate America, hate our military (although I know a few that do and that pisses me off more), and blah, blah, blah

What could it hurt?

8. Liberals don't hate our troops! Stop saying that!
Just look at the respect and faith of our military in LBN. Not one liberal is bad mouthing our troops and they are with them 110%!

We have to stop saying liberals are against our troops!

21. The problem with this argument is that...
some dems on TV are comparing Iraq with Vietnam, and not only does this fuel the enemies' convictions against the coalition, but it breaks the will and morale of our troops who hear this

The war is on. Support it AND end it.

23. By end it, you mean...
end the war, right? The sentiment from Americans towards this war is the same towards Viet Nam back in the day.

28. Christ, I of all people should know that
my husband is one of those troops... I just said I am sick and tired of hearing people (i.e. REPUBLICANS) claim that liberals do. Oh, sure I mentioned there is a person or two in the country who happens to be liberal who happens to think all soldiers are warmongering idiots. Guess what? I know some CONSERVATIVES that feel the same fucking way!

IT'S A VERY SMALL GROUP OF PEOPLE, BUT THEY DO EXIST.

5. If you want a counter-argument, just say that Bush is hoping
for another terrorist attack. NY getting nuked would be the best thing possible for his career.

6. You could try it, but...
he does have his freedom of speech, no matter how much you hate it.

I hate that disgusting fatass pig-boy, but I don't think you can do anything about it, as much as that hurts. :(

11. Yes, but with freedom of speech
You still can't yell fire in a crowded movie theatre. Isn't what pigboy does about the same?

I find it particularly offensive due to the fact that I've spent almost 20 years proudly wearing the uniform of our country.

I've always said that Democrats and liberals support our troops, while repukes support the Boeings and Lockheed Martins of this world.

If repukes are so good for the economy and for national defense, why in the hell does history not support that argument? Under the last Democratic President we had the longest economic expansion in history, and the gap between rich and poor grew smaller. We also had relative peace and prosperity and our military seemed a hell of a lot better protected, our country also seemed to be a hell of a lot better protected.

Another point while I am on it. Why is it that the crime rate was greatly reduced under Clinton, but under the "law and order" party the crime rate has increased steadily since joker was sworn in?

14. Whoops, sorry
Yeah, if I were you, turn pigboy in. You seem like a great serviceman and you seem like you care about this country.

I hope the FCC responds to you. I wonder what they'll say. I'd love to see pigboy thrown off the air.

Good luck, maxrandb.

10. I'm not a lawyer.

But I think speech is free until it actually causes harm. There must be lawyers online who can speak to this as there is precedent, I'm pretty sure. But I feel certain there have been cases before the Supreme Court addressing the issue of speech that causes harm to others.

I think you are addressing the harm that comes from the assinine hate speech that Republicans are excusing from their mouthpieces. Perhaps an email to the Southern Poverty Law Center or Talkleft.com. I'll look for some links.

It's worth a try. Yep, the deck is loaded against us right now. But perhaps some suits should be filed to further define the precedent.

20. Go for it!
Make a stand. How many times have the damn freepers filed suits. Remember the suit in CA where they got $60,000.00 and they also posted and thanked * since he made a phone call to pay them the cash. It's about time we file suits against these people to show them we're aware, educated, and had have enough of their lies, slander, and put them in their place. You can even try contacting ACLU, and if you don't have the cash, look in the phone book for the ABA and they can refer you to pro bono, or call Legal Aid. Many attys have large web sites advertising what services they offer. Another thing, there are quite a few attys who attend the marches that you might want to look up, they might do the case free..What state do you live in?

15. Thank you for your service
for me and our Nation. It is people such as yourself who are bearing the burden and I am trully gratefull. I am a veteran of the Viet Nam war. I am not bearing today`s burdens. I feel it is important for men such as you especially, and to a lesser degree veterans such as myself, to stand up and be counted as Democrats. It is certainly worth noting that the Democratic Presidential candidate, JOHN KERRY, is a highly decorated WAR VETERAN as opposed to the CHICKEN HAWK in CHARGE. Thank you,....Oscar

They're afraid we could control the FCC and shut them down based on obscenity.

Tell them they'll never get your business while they support such efforts to misrepresent the political beliefs and patriotism of people like yourself.

explain to your daughter that he is a drug addict and addicts often don't make any sense.

25. Sorry, under tort law (criminal would not apply here), you have no cause
of action. Unless you can prove negligent infliction of emotional distress. Which doesn't always hold water, in most states. And which is very hard to prove, in any state.

My advice? Just keep educating your daughter.....

This is the best that you can do.

27. The BEST he could do, is publicize the incident,
if he can find a way and can afford to. If the best way is to bring a lawsuit and he can find someone to do it, he should go ahead and do it. It doesn't matter whether he could win. What matters is exposure of hate speech against half of all Americans.
