1. Before you vote 'None of the above,' REMEMBER
Bush only won the SCOTUS vote 5-4.

Souter, Stevens, Breyer, and Ginsburg dissented.

2. Ruth Bader Ginsberg for the following quote in a sexual discrimination
case:

The differences between the sexes should be a cause for celebration not denigration.

3. OK, who's the joker who voted for Slappy the Clown!

(actually, that would be a 7 of hearts)

And if someone has the balls to 'fess up (which they probably won't), exactly WHAT is admirable about being Fat Tony Scalia's Clone and Second Vote?

I'm waiting to hear...

4. It happens in every poll where a conservative option is offered.

Crashcart Cashcow managed to garner five votes in my "Best Recent VP" poll.

They won't admit it because they know that coming forward would probably lead to their being tombstoned. Polls are the only place around here where they can get away with being openly conservative without risk.

Either that, or we have a few smartasses around here.

6. My very favorite justice ever...is.....
Earl Warren. That man could write and he was the best liberal ever! Understood how to interpret the Constitution as a living, evolving document protecting fundamental rights! 2) Thurgood Marshall 3) Justice Cardozo. That's after being forced to read thousands of opinions in law school.

7. The conservatives went nuts over Earl Warren,
an appointee of Dwight Eisenhower. They expected him to lean more conservative, I suppose. There were calls to impeach him. But you're right; the Warren Court handed down some of the most liberal opinions in the history of the court. And I think the United States is better for it.

another great past judge was Thurgood Marshall, William O Douglas was good too, as were the majority of FDR's picks.

16. FDR appointed more justices to the Court than any President
with the exception of Washington, IIRC.

8. I'm a fan of Justice Black's literalism
If the wording of the clause contains no qualitative limitations ("unreasonable" in the Fourth, for instance), only the gravest national security concern should be enough to trump it.

10. I'm pleasanty surprised over Justice Souter.
I'll bet Souter's appointment is one that George I is disappointed over.

Justice Souter has been a moderate voice on the Court. He sided with the minority in Bush v Gore, has been surprisingly good on the court cases involving gay rights. Souter has become one of the moderates...besides Stevens, Ginsburg and Breyer.

18. Good try on his part.
and thanks for nothing, Kennedy and O'Connor. I used to have respect for them as moderates, but they let us down on this.

I wonder if the Court will find for Cheney in the Sierra Club case?

19. RBG, "I dissent."
Gotta love the way she made her point.

For the knowledgeable among us (those of you talking about past justices): what do you think of (is it Robert?) Jackson? I've seen a few citations of his remarks concerning the Nuremberg trials and the pledge of allegiance case in '43, and I liked what I saw. Please enlighten me further, if you can.
