Bush looking for Ruling to designate US Citizens Enemy Combatants
Happening right now:

On April 20 04' the U.S. Supreme Court will hear oral arguments on the President’s alleged right to create a “law free zone” at the Guantanamo detention center in Cuba.

And on April 28, the Court will hear oral arguments on the President’s asserted right to designate "CITIZENS" as “enemy combatants,” hold them at the U.S. Navy base in Charleston, SC, and deny them the ability to challenge the lawfulness of their detention.

We believe that the President cannot be allowed to create a “legal Black Hole” into which people are dropped with no recourse to the courts or to international law. Among us we hold many varied views on how and why this situation has arisen and what is ultimately needed to ensure justice. But we all agree that this dangerous new presidentially-designated category of “enemy combatants” who have no legal rights is unjust, illegal, and immoral, and cannot be allowed to stand.

The silence over this perilous issue must be broken, and public opposition must be manifested. Join us in front of the U.S. Supreme Court on April 20 and April 28 to declare a resounding NO! Legally permitted, non-violent demonstrations will occur on both days from 9:30 am to 12:30 pm with a program of speakers beginning at 11:am.

Our future and the future of hundreds of anonymous detainees now hang in the balance. This is a watershed event in history. What is at stake is just how much the President will be allowed to get away with. Your silence will be taken as assent.

1. I wonder if Democrats will be considered, Enemy Combatants?
Anything is possible, I guess?

3. Anything is not only possible
but increasingly probable.

Why would they want this if not to have in mind the intention to use it? The shoe bomber was the test case. How long has he now been held? Where the hell is he?

When will people get it through their heads that the intention is to create a society of people who only follow, at least in word and outward action, the beliefs of these "leaders"? There is no end to what they will do to accomplish their goals. Get that impressed upon your cerebrum right now.

4. If you are not for Bush and his policies...
...then you are against him. He has made that pretty clear, so yes I would think that democrats (U.S. citizens to belong to a party) would be considered enemy combatants, if opposed to Bush -- Patriot Act II.

24. Well, I know I sure am!
LOL! All anti-Bush protesters, etc., will be designated as such. But, after the second American revolution, we won't be called that any more. :)

5. What is AMAZING...
This is a real happening...it's not gossip, it's the real thing!

It is stupefying to witness people chatting up the curiosity into Michael Jackson's sex life, what Chuck Hagel said to a talking head, or if my zit had a baby zittette yesterday.

27. I listened to the oral arguments on CSPAN yesterday
You don't always know how the Court will fall because of the arm-twisting that goes on behind the scenes, but it appears to me from listening to the Justices' questions that the Bush Administration will lose. Justices Kennedy, Breyer, Stevens, Souter and Ginsburg clearly weren't buying what Olson and Scalia were pushing. I think we're looking at a 6-3 decision or better.

7. This would be a Federal Law advancing Super Powers to the President...
at his pleasure-

To answer your question:

I would think a federal agent or militarist would appear at your door, armed and ready to take you by force, if you were unwilling to comply, into a waiting vehicle to S.Carolina.

Bush is claiming in the Jose Padilla case that he can label me or you or any other citizen an "enemy combatant," and all our rights disappear, and we can be imprisoned for the rest of our lives without charges, without access to our family, and without access to an attorney.

21. There are tons of loop holes
Example: Several years ago the US government could not tap your phone lines under US law.

But guess what? There is no law saying Canadian officials can not.

The Canadians were tapping US phone lines, while the US returned the favor by tapping Canadian lines. They then exchanged the information.

22. Thanks for that, AGD..
Bush obviously intends to combine the new Executive Powers, Judicial reviews, and Patriots Act I and II into one big homogenized DICTATORSHIP!

I've just e-mailed my Congressmen.

Their response will be interesting.

The Patriot Act and approval of Pats Act II..

Preliminary rulings concerning these issues have already been made..Hallelujah!

"But presidential authority does not exist in a vacuum," they said, "and this case involves not whether those responsibilities should be aggressively pursued but whether the president is obligated" to share them with Congress.

The majority said that a law known as the Non-Detention Act provides that "no citizen shall be imprisoned or otherwise detained by the United States except pursuant to an act of Congress." The court said the joint congressional resolution authorizing operations against terrorism after Sept. 11 "contains no language authorizing detention."

In dissent, Judge Richard C. Wesley said he believes the president had the power to "thwart acts of belligerency on U.S. soil" and said it was startling that the majority would find that the president lacked authority to detain a citizen terrorist who was "dangerously close" to executing a plan.

Excellent infolink
