Apparently there's a document which describes exactly the torture that was occurring.
The documents available are merely legal advice regarding hypothetical torture. But one of the documents accidentally refers to the existence of a document describing the facts upon which the legal advice is based.
That's the impression I got from Democracy Now! this morning.

that he refuses to release to the Committee even though portions of it has been leaked to the press. By law, Ashcroft has to provide them to the Senate unless Executive Privilege is asserted regardless of the fact that some of the memo is already out to the public. The memo that was leaked was not complete and there were attachments that were not part of what was made public.

...that he refuses to turn over to Congress were memos from him and others in the Dept of Justice to the White House and President in 2002. There is however evidence in this DOD memo that indicates that there has been previous "advice" summarizing the Executive Branches legal implication when it comes to the issue of torture etc...(probably even direct references from those memos)
