What in the heck is judicial temperament?

What in the heck is judicial temperament?
The Shrub is in NC and was just answering reporters questions on CNN & MSNBC. He said a lot of dumb stuff, but one thing has me curious. He said he doesn't have any litmus test for his judicial nominees. He makes his recommendations based upon their judicial temperament. A few Dem. senators are blocking my nominees because of their judicial temperament, and that's wrong!

I thought I had a fairly good command of the English language, but I don't understand this one.

The concept of judicial temperament indicates a person who is capable of approaching disputes with a minimum of preconception and a determination to be fair to all involved, who it is difficult to sway by emotive appeals, and who will, so far as is humanly possible, set aside his or her own views and inclinations in any matter, to render judgement solely on the evidence and the law of a case.

What this reptile means by stating many of his appointees are rejected because of their "judicial temperament" is that many of the wretches he has sought to place on the Federal bench have given ample evidence that they are incapable of meeting the above requirements, but instead have every intention of using their bench, and whatever cases come before them, to impose their own views on the cases, regardless of the law and the evidence. That is an emminently proper reason to oppose any nomination to the judiciary.

e. Judicial temperament.


A candidate should possess judicial temperament, which includes patience, courtesy, impartiality, even temper, a well-defined sense of justice, compassion, fair play, humility, tact, common sense and understanding.

Among the qualities which comprise judicial temperament are patience, open-mindedness, courtesy, tact, firmness, understanding, compassion and humility. Because the judicial function is essentially one of facilitating conflict resolution, judicial temperament requires an ability to deal with parties, counsel, jurors, and witnesses calmly and courteously, and the willingness to hear and consider the views of all sides. It requires the ability to be even-tempered, yet firm; open-minded, yet willing and able to reach a decision; confident, yet not egocentric. Because of the broad range of topics and issues with which a judge is typically required to deal, judicial temperament requires a willingness and ability to assimilate data outside the judge's own experience. Moreover, it requires an even disposition coupled with a keen sense of justice and a recognition that the administration of justice and the rights of the parties transcend the judge's personal feelings and desires. Judicial temperament implies, among other things, an absence of arrogance, impatience, and arbitrariness.

5. Thank you very much for the facts. Wonder if anyone in the media
will try to explain this to the general public? I think it would be great to be able to prove, with the Shrubs own words, that he is openly lying to them!
